Can I refuse to speak to ATOS outside my contractual working hours if off sick?

you can only be refereed ti OH assist with your permission anyway, you could tell them you are only willing to speak to them at set times but is there really any point in doing that? better to try and get them on your side from the start

make an appointment for them to ring you between 9am and 1pm

why not? you dont need to speak to them if you dont want to, again RM need your permisssion to be refered to them, what difference does it make to you what time of the day you speak to them? they usually ask you when is the best time to speak to you so whats the big deal with insisting its only during working hours when they will simply do it then for you anyway?
