Complaints/grievanvce are complete shambles

Post by Jomum »

I've just had my appeal interview for a complaint not upheld. The initial meeting minutes were a pack of lies and the new minutes no better. I was promised representation from higher in the union as also have a solid grievance but nothing!
Being as my grievance won't be dealt with until I'm back from sick they have also managed to make it that I've missed the deadline for et apparently? But although it went in on such and such date they are the ones who say it won't be dealt with until my return??

I am not fully understanding your posting.
You have had an appeal interview in which your complaint was not upheld what did you submit this appeal in relation to?
You are presently off sick and you have an active grievance and obviously this cannot be heard while you are absent.
You also state mentioning that you have missed the deadline for an ET hearing is this separate or connected to the appeal interview?
You have 3 months to lodge your complaint but under recent legislation in the interim ACAS are notified in order to reach a settlement without having to go to a full blown hearing at the ET and while this is on going the 3 month clock stops and if there is no agreement finalised at ACAS stage the clock restarts. So how have you missed the deadline?

Sorry was ranting more than anything. Am off sick and have a b & h complaint and seperate grievance. I've been told that the grievance will be dealt with when I go back to work but the grievance is obviously about something that happened whilst at work which was over 3 months ago so I was under the impression that from the date of the incident I only have 3 months?

No remember your grievance can be taken to different levels of authority.
An ET will before considering your application that you have a reasonable success of winning that you have utilised the company's procedures before application and then you can place your complaint to them. As you are still in employment and off sick and have not been unfairly dismissed have you in fact presented an ET1 for consideration in what happened at your work 3 months ago while you are still awaiting for your grievance on the same complaint to be heard.
The 3 months regulation is not mandatory and can be waived in certain circumstances and if you can prove that your grievance has been postponed due to sickness then there should not be a problem provided that you have entered the date on your application to the ET1 from the time of the incident that your complaint is about.

Your reply has settled my nerves a bit thank you! , I havn't filed any et1 form and don't know the ins and outs. Unfortunately I can't seem to get hold of anyone at the union to get any help and my rep is quite new to it.

Bit of an update I had a letter sent saying I now need to go for an appointment with royal mails doctors as Im off work. Just wondering and worrying about what to expect. Everyone is telling me to not worry just go in and be truthful , the truth is on my side. But we all know that rm will try to twist me up and stitch me up at any time so any advice on what happens at these appointments will hopefully steady my nerves

Do you not have your own doctor? who has spent the best part of their life looking after people or should you see a quack appointed by Royal Mail who may or may not be a doctor and will make any decision on who pays their wage's!

To be blunt you HAVE to tell the truth and be be frank, open and honest about your condition/medical problems. Don't even try to over egg it.

Ok there is a chance that RM will disregard or downplay it whatever the report says, but if you want it to be handled correctly and professionally, by Royal Mail, or you want/need a particular outcome, then the more honest YOU are the better chance you have.

Also ultimately if you do decide to go for an ET, they will find out if you were no honest about your condition, and it will detrimentally affect the outcome, same as it will for an B&H complaint or grievance.

Ultimately, you owe it to yourself to be honest.

Don't get me wrong I've no intention of being any other way. To be fair I've always downplayed my condition if anything, much the same as a lot of people who are genuinely disabled do. I've never wanted anyone sympathy, the hard thing is gonna be to swallow my pride with doc and not downplay it. I'm hoping that it won't go as far as et and I'll be back to work as soon as possible, but as I said we all know what RM are capable of and it will be helpful to know what the chances are that the doctor is gonna be genuine, and do what he needs to do or in RMs pockets trying to get me out the door, by whatever means?
