how soon after an incerdent should either an informal or formal fact finding interview take place if they beilive they could be a charge to answer ..

Fact finding interviews are normally informal ( no note taker present) and some union reps will wait until the formal conduct interview before representation however my personal view is that you be accompanied at the fact finding interview by a work colleague or union representation as a witness on how the FF is proceeding.

Are you sure that is correct? Normally informal? I understood that it was normal to have a formal fact finding. In some areas managers may wish to have a note taker present informing you that the note taker is present merely to take notes and has no part to play in the decision making and more than likely the manger can't be bothered recording the discussion and questioning at the same time.
In other areas managers will conduct the FF on their own and take their own notes but as there are no charges made until the return of the FF notes with amendments if necessary then basically it is informal.
Once charges have been made and a letter issued that the matter is to become a Conduct Code issue then it becomes formal.
