If you have worked 12 weeks previously on duties that are more than your contractual hours are you entitled to average those hours to enhance your wages when your on annual leave.
Say for instance your on 25hr contract and covering 39hr duties
I'm sure I've seen employment rights that state if you are covering a static duty to cover long term sick, maternity, gap year etc, you are entitled to that AWD hourage for that duty ??
Could someone please find me an agreement on this ?

You can bet your backside that if it did come in it wouldn't be backdated and the chances RM would sanction it is very unlikely.

It will be a ruling, not an agreement, so they will have no choice but to enact it as per the judgement. That's probably why its taking time, they are probably looking at the financial impact on businesses and will come down on their side as much as they can.
