Im currently on the sick from injures from a car accident, iv been off a few weeks now and have been going through occupational health that have said im unfit for work at this presant time, my gaffa has been phoneing me asking me how i am and seeing if im fit for work, which im not. the last phone call he said that he has been speaking to an independent nurse and said that she has access to my medical records from my physio that my insurance company have organised for me and has advised him that im able to got back to work doing light duties, stating the amount of pain im in has reduced enough for this. I actully went back a few weeks ago and had to go back on sick because he didn't stick to my rehab plan and basiclly forced me into doing to much,

Question is who are these independent nurse's and how do they gain access to private medical information that only my insurance compnay has.

Or is he just full of s**t and playing mind games to get me back to work before im ready to save money on his budget

He is playing mind games with,I'm married to a nurse and I can assure you that if he/she were to do what your manager has stated they have done,they would be up before the RCN (Royal College of Nursing) and almost certainly struck off the register and therefore out of a job.

Just stick to your guns and only go back when you and your GP feel you are able to do so.

I have had a broken foot operated on,been off 2 months,should be off another 2,manager wants me in answering the phone.I have a not fit for work note.It needs elevating and i dont want it knocked so unlucky Mr manager

Next time he phones, tell him you will be suing him for breach of the Data Protection Act, ask him for the name of the nurse as well,as you will also be suing her for breach of data protection and reporting her to the Nursing and Midwifery Council for breach of patient confidentiality, they are the professional body for nurses and breach of patient confidentiality is a very ,very,serious matter. That should shut the clown up. Hope you get better soon .

if he keeps phoning you up mate go to the doctor and say that your manager is trying to make you to come in sick. say how stressfull this is to you, you cant sleep as to the worry of weather you have a job when you get back blah blah blah. then put a b@h complaint against your manager

Did this independent nurse examine you over and above RM occupational health OH Assist because I get the impression that as she is basically working and being paid by the insurance company then it is in her best interest to get you back to work.
RM normally accepts the decision of OH Assist but I would be making tentative enquires as to how the independent nurse has been given access to your medical records
There seems to be a severe breach of the Data Protection Act and you should request copies of the report that the independent nurse supplied to your manager and take it further.
