Bank Holiday excess payments

Anyone know the definitive ruling on this?
My office, dundee , have, up until the last bank holiday, always had a choice of day in lieu or paid for it.

Now, weve found out we are gettin just a day in lieu, which will alwys be denied , due to low staffin levels.

If you opt pay + day in lieu it is usually added to next years leave entitlement, that is the case where I work anyway.
