Advice Please

Got a medical condition and ATOS has given a supporting view. Can a manager over ride that decision. What is the procedure to leave via ill health walking out is the other option. Having to justifie that I have a medical condition is now bringing on stress. Not a good place to be but my health and well being comes first.

Firstly, don't walk out... that's exactly what they want you to do... any DIM who ignores an ATOS report is playing a dangerous game but many do... ATOS can recommend IHR after yourself having a consultation with a specialist relevant to your illness/disability... I believe you have to have been unable to do your templated role for 9 months to get IHR and the business may consider giving you a role somewhere else as an alternative... if you are suffering from stress you need to speak to your doctor as you may not be fit for work... sorry to hear of your problems... all too prevalent these days... RM is an uncaring organisation... good luck...

Are these ATOS recommendations worth the paper they are written on?
The reason I ask I know of a gentlemen from another office who has quite serious knee issues so ATOS recommended to his manager at the time to put him on a duty where there wasn't too many hills and steps....which initially they did for a period of time...now the park and loops have been introduced this poor chap has been put on a rota duty(that was all that was left) where virtually every day he is working in areas with high numbers of steps and hills.
So basically management have ignored ATOS in every way shape and form.

if the atos advice is in writing and your manager completly disregards it you must first and foremost get in touch with atos tell them who your boss is explain that you cannot do as he is asking as you are not able to do what he is asking and the pressure he is putting on you is making you stressed and feeling singled out and depressed and you are feeling suicidal at times as you dont know how to make your manager treat you as atos have advised also see your rep and lodge a grievence against the manager for bullying and go down the i/r framework dont be bullied stand up for yourself with the union behind you thats what you pay your cons for good luck

Why would they tell ATOS they are suicidal?
Sometimes I wish people who give such stupid advice would just f**k off.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

Firstly there is no viable reason for taking a decision of walking out which is a totally negative approach.
You have followed the correct procedure with a referral to OH Assist ( formally ATOS) and somewhere in their report which you would have been copied into will be their recommendations on how they assist you in a return to your signed duty.
This will entail modified duty or reduced hours and a rehabilitation plan tailored to your needs and you will be required to attend weekly rehabilitation meetings designed to monitor your progress or if an extension to rehabilitation programme is required. Plenty of paperwork which is probably the reason that DOM has ignored the OH Assist.
However his refusal to accept OH Assist decision leaves him vulnerable to a compensation claim should anything occur to your condition by his refusal to accept OH recommendations.
You need to put pressure on DOM and re-contact OH Assist through your reference number and explain to them that their advice is being totally ignored and ask them to report direct to the next level of authority ( DOM's MANAGER).
Furthermore I would commence with a 2nd stage level of grievance which is monitored through ER Operational Team at Sheffield who will flag up your situation and send with your grievance a copy of the initial report from OH Assist.
Point to remember is when a referral is made to OH Assist who is RM appointed occupational health provider you come under their umbrella and outwith your DOM's authority and he is treading on hot coals by ignoring.
Would also suggest that you inform your local CWU rep to start making waves to management on this situation.
You are in the right your DOM is in the wrong its as simple as that.

Than you all again, there is hopefully a solution going to be reached. Where I have gone wrong is not wanting my medical condition to let people "down", but I can see a positive learning experience from this situation, in the past I would only see negativism.
