hospital appointments when you are a carer.

Can anyone shed some light as to what the rules are regarding hospital appointments when you are a carer for either disabled children or a partner.
2 people from my office are having problems with trying to get time off to attend hospital appointments - management want them to swop there days off even if they have other plans made for there day off or come in and do IPS and prep but lose a full days pay.
Management are implying that it is not there problem and that they are under no obligation to give the 2 people in question the time off but if they do it is with no pay is this correct?
101 questions are also being asked in regards to what they are doing on there days off that they can’t swop, why they are being unreasonable, etc
Any help is appreciated so I can pass on the information

For hospital appointments with consultation by a specialist who work within their own limited surgery hours then a special leave request form should be completed and is paid and at mangers discretion but difficult to refuse. At the other end of the scale if it was a hospital appointment to visit an out-patient department then it would not be unreasonable for the appointment to be made outwith working hours. Any appointments that can be rearranged would be unpaid special leave or be deducted from holiday entitlement. You can request flexible working for a disabled child up to the age of 18 which is the law but employer can refuse on business needs but again would have to have a good reason for refusing. Paid special leave is available for URGENT DOMESTIC DISTRESS and on certain conditions can be extended to 3 days.

Read that thread it might be of interest, they are allowed to take time of unpaid and only need to inform the employer and not seek permission . Tell them not to expect to be paid though.

I have a kid who is disabled and sees a specialist at least once every 3 months, i take a days parental leave each time he has an appointment.

how many hours do you work ? if your working 39 surely you can not legally be a carer receiving cares allowance

To get carers allowance you need to be a carer for 35 hours or mor a week, so as there's more than 74 hours in a week yes they would be entitled to carers, subject to the person being cared for meeting the requirements.

ive just looked into it you can not earn more than 100 pound a week

Obviously been a recent change, as I was offered it for my dad 2 years ago although I was working full time for RM, though I never claimed it , I was eligible. What I quoted above was what the DWP said at the time.
