yes you can make a claim, as he gave you advice prior to going out RM will not be 100% liable but not 100% off the hook, when it goes to court(if it gets that far) then judge will award an amount say £1000 but find you say 25% to blame therefore you would only get £750 so the fact that Lino gave advice doesnt get them off the hook completely, get the ERICA started asap and get onto union rep to put you in touch with simpson and millar

I'm sure you have a cast iron case for a claim... Firstly by showing that your equipment or vehicle was presumably faulty or not fit for purpose, then you simply have to demonstrate the current or future earnings you have lost due to the mental or physical impairment you are now presumably suffering from.

But for the wind, the accident would not have occurred. The person who had control over your use of a vehicle in those weather conditions was your Manager, telling you to be careful does not absolve them of that responsibility.

Also, if there is no record of your Manager having ran the Severe Weather Tool, (which should have been done with the Safety Rep or other Nominee in attendance), then they have not followed the correct process.
