Just after some advice about a dog bite I suffered today and can't get hold of my rep. I work in a sub's office and while out delivering parcel to an address they weren't in but next door came along and said she would take it. She had a dog on a lead and as I approached her the dog lunged and bit just above my knee on my right leg. Owner v apologetic and gave me some first aid. The bit that's concerning me is when I rang my manager to report the incident I was 'encouraged' to report it as a near miss not an accident because I approached the person with the dog and therefore I'm the one at fault for the incident, got to go into the office tomorrow to fill in a report. Am I right in thinking that my manager is trying to pull a fast one here and I should actually be reporting it as an accident. :hmmmm

Yes he's trying to get away with an accident in his office. Get some pics of the injury as proof if your camera has a time and date function use it. When you return to your office make sure you fill out the ERICA form ( you decide what to put in it and when , not your manager ). Also report it to the DWP as it is then registered as an industrial accident. If you report it to your rep or better still the H&S rep it will be reported to branch and they usually send a DWP form with a union solicitors form if you wish to make a claim. If you do want to make a claim keep all receipts , prescriptions and car parking tickets etc to back up your claim. Also you may need a tetanus injection to.

his is not true, it must be started within 48 hous of accident happening and also there are parts that the manager fills in not the person who has been hurt, the person hurt describes the accident thats your only real say on what goes in, the manager may/should ask you other questions about the accident and your answers should go in as wel
True I was just pointing out don't let him/her coach you or edit your replies

If the skin was punctured you definitely need to see a doctor and get a tetanus jab, but you can be polite.
Being defiant won't help.

Any incident which results in an injury or damage to property, however minor is an accident, it must be reported through the ERICA system, (Online Accident Book) and it is against the law for your Manager to attempt to write it off as a Near Miss.

The Manager has to report the accident to the Police and any local Dog Warden and has to investigate it properly, (preferably with the assistance of your appointed local or Area Safety Rep). I would suggest you get the injury looked at by a health care professional and request an Injury Claim Form, (LS3), from a CWU Rep or your Branch.

I can tell you that the person holding the dog on a lead who invited you towards them was responsible for the control of that animal and was also the most likely person to know how that animal would react to your approach.

Speak to your CWU Safety Rep, or telephone the Area Safety Rep, and give them the facts before you speak to your Manager again. If you do not have his number get it via your CWU Branch, (their number should be available online if you don't know it).

Wrong, there is no such stipulation for a time lapse between having an accident and reporting it in the accident book, (E.R.I.C.A).

Royal Mail may have an internal deadline but their Manager's deadline and your legal rights are completely different, they cannot stop you from reporting an accident after that time has elapsed.

not wrong i never stated it was a legal deadline, it is royal mails, if you read the previous post he was being advised he could report it at anytime he wanted which is incorrect, hence i advised him what his obligation is under royal mail

Thanks for the replies people. I was pretty sure the gaffer was trying to get round something as thought it was supposed to go on an ERICA will get it sorted tomorrow after speaking to a rep

You most certainly stated that IT MUST BE STARTED WITHIN 48 HOURS, that is 100% wrong and yes they can report it at any time they want.

I would not recommend that there is any undue delay in reporting the accident as the delay could jeopardise the safety of others; but the fact is that there is nothing to stop them from doing so other than the fear of a Manager who has been penalised for having missed an internal deadline.

its not 100% wrong its 100% correct to comply with royal mails requirements, also i didnt say you cant report it after 48 hours just that you must before 48 hours

as for them being able to report it any time they want, well i would suggest that you read up on the HSE requirements for reporting accidents as they require that RIDDOR accidents are reported to them within 15 days of them occuring

in fact its actually in our employment contract about reporting accidents and injurys and it states quite clearly on this

"You must report all incidents, near misses and personal injuries straight away to your line manager"
