having a smoke on way back to van

does having a smoke on the way back to the van (could take me 5 mins from van to deliv and back again as parking is a nightmare) count towards the meal breaks as my manager is starting to be a p***k over this he has started saying yes it counts towards meal times.i said your having a laugh as i was walking back to van ...can anyone tell me if this is true or was the bugger winding me up

If theres an issue with parking whilst on delivery this should have been looked into.Its not our problem its theres.Personally if he/she is being arsey tell them in future you will return to do and take second portion of meal relief there, then watch the look on there faces when they realise that in doing so it would mean you cutting off more work for them idiots............ :Very Happy

He is winding you up. Return the favour.

Tell him you'll stop and have a smoke and then start walking back then which will cause you to leave five minutes worth of mail. Royal Mail managers are idiots they are easily defeated.

How does he know you have a smoke on the way back to the van anyway? If you get a secluded point through one of your loops just have a fag there if you feel he will be watching you.

I'm not sure how that will work as you are not entitled to time for a fag break.
Just give up is the easy solution.

Answer is no, i dont care what anyone else says they are wrong. In the way forward check out the section on irregular attendance patterns. Section 5 page 22
There is a section which says you can split breaks, but these are options and not compulsory.
If your person in charge is insisting this is a break then it is a grace break and surplus to your MR and as such can be removed as and when they like

You are legally entitled to a 20 minute UNINTERRUPTED break during your shift (i.e. not at the beginning or end). A 5 minute walk followed by work cannot fit into that.

A manager asked me a work related question last week when I was 7 minutes into my break so I restarted the 20 minute clock again!
