Tampering with mail

Got a question for a CWU Rep? And all CWU related matters.

Tampering with mail

I discovered last Friday that union mail addressed to me personally in my name, addressed to the delivery office had been opened and resealed. I was on leave the week before and 6 letters came in the post when I was off.

I reported the incident to the stand in manager who was covering my DOMs day off and he left a note for my DOM so he could deal with it.
When I returned to the office that Friday afternoon, I discovered the mail was now gone, taken from my frame.

So it has gone from tampering with my mail to theft.
It was my long weekend, so I have no idea what if any actions have been taken. I don't see eye to with either my DOM or supervisor, I'm expecting this to be brushed under the carpet.

What actions should be taken ?

tell your rep, fact you work for r.m is by the by. theft is theft, report to complaints. while you at it ask them why they tamping with your mail

........... but be careful about jumping to conclusions.

As you reported to on an official basis it may be that they have started a proper investigation. Just as in the case of scummie posties knicking or not delivering letters, they may keep the item for some time whilst the investigation is carried out.

But I most certainly wood involve the rep, and would keep pressure on them to return the item and conclude the "investigation" in the quickest possible manner. I would also ask why they have taken the item, when it was in your personal possession, without agreement.

Word of caution, was it stamped addressed mail or Royal Mail pre paid envelopes being used ?

Neither, it was internal mail. Should that make a difference ? This was still my mail.

I am/was the rep, a still learning rep at that. I was voted in as the rep when our office went from a SPDO to a DO after our revision and the office had a couple of other smaller offices move into ours.

I resigned as the rep a few weeks ago because my life since becoming the rep was being made like hell, from both our new DOM and the supervisor who used to be our manager pre revision. That with personal home problems, I could not be bothered with the hassle any more, so quit as the rep.

I am however, standing in until a replacement can be found and so still receive union mail addressed to me in my name.

So, what actions should "the" rep take ?
I obviously reported this to the main union guy for our area, but as yet have heard nothing.

Nothing, but he needs to kept in the loop in case you need help on it later, and especially if the managers somehow turn it back on you, hopefully thats an extremely unlikely scenario but if he is already in the loop it will take him less time to get up to speed, and therefore be able to nip problems in the bud.

So, am I to assume this should be treated like any other tampering/theft of mail ?
Theft of mail should surely trigger the IB to be involved ? or is that a step too far ?

just one slight point

its not tampering with mail in anyway unfortunately, as we say to customers, we deliver to addresses not people, so the fact that it has been "delivered" to the DO as that was where it was addressed to means that the fact that its been opened is not an offence, same as if you opened your wifes mail at home.

it is definately theft though

Interesting.

So, if I were to open a letter addressed to my DOM, even though the letter in question had his name on it, but was addressed to the DO, I have not committed any offence and the DOM can not take any actions against me ?

he might be able to prove a charge of theft but definately not mail tampering

The reason I asked is that it may have been the reason that they have taken the mail pending investigation. In our area they were hot for a while on CWU reps using Royal Mail pre paid envelops for CWU correspondence. Rep to member or Rep to Rep.

Well as expected, he brushed this under the carpet. But not before trying to twist this onto me and in my opinion, almost blaming me for leaving them on my frame! All he was interested in, was why it took me until the Friday before reporting it and why were they on my frame.
Why the hell that should make a difference I will never know, because I walked out of the conversation.
As for the theft, all the letters were taken into the office, but without asking, nor telling me first ?

Oh and I still have not heard a thing back from my area rep!

Without wishing to be too harsh, he may have a lot of other issues to deal with (what with impending strike action) and your non-issue may not have even registered on his radar.
The mail wasn't stolen. It may have been opened by one of your colleagues who thought it might be something important they needed to know about while you were off.

That's only in relation to mail before it's correctly delivered, after it's been correctly delivered to the correct address they are not committing an offence under that act, thus not tampering with mail,

But as I said it probably would be theft
