part time workers bank holiday week agreement
evening everyone, can anybody please give me more insight on any agreements regarding bank holiday weeks and the percentage or fraction of hours that has to be completed during a bank holiday week by part time workers. i have looked through the way forward agreement and there is nothing in regards to this issue. i tried to enquire from colleagues, some say its 2/3 of your contracted hours, others say its 4/5 of your contracted hours. i need clarity on it. and should there be an agreement already existing please feel free to mention or post to me for reference.lastly, if there is any knowledge of how true it is that part time workers are only entitled to a certain percentage of a bank holiday day of,and not the full day. cheers

The way mine gets calculated is based on the number of days I work. So if there are 8 bank holidays a year and they all fall on my days off, as I work 3 days I would be entitled to 3/5ths, so I would get another 4.8 (5days) added to my annual leave. Any bank holidays where you would normally be at work are not counted as you already are paid for these.

Surely if you only work 6 hours a day, your bank holiday pay would only be 6 hours. If you work Tues - Sat you'll be entitled to all Monday Holidays. If you work Wed - Sat and Tuesday is day off, Monday bank holiday, you'll get paid for the holiday(part of the hours that week). I could be wrong because RM do have the own rules

Really? If its your day off then you get the day in lieu surely? It doesn't matter if its all 8 or none. If it were just 1 that fell on your day off you wouldn't get 3/5's of a days pay would you?Lincox wrote:The way mine gets calculated is based on the number of days I work. I could be wrong but that doesn't seem right....

He is right for people who don't do a full working week - every week. Because they only work a fraction of the week then they are only entitled in law to the same fraction of banks holidays - and when they are entitled they get their basic for that day, just like when on annual leave.
Anyone doing a full working week gets paid the same basic pay even when a BH falls in that week. This is the same for AFAIK all the ways of working as long as they are based around a full working week where FTs get paid on a basic week for 39 hours - ie 9 day fortnights 1 in 6 etc.

Re: part time workers bank holiday week agreement
PTers that work set days every week, with their depot having undergone a Delivery Methods, need to be on the ball this financial year. There are 8 bank hols (as per normal) Apr2013-14, but 4 of those fall at times when said PTers may not be scheduled to be at work (for England OPGs at least, could well be more complicated in NI or Scotland)...
Weds 25/12/13
Thurs 26/12/13
Weds 1/1/14
Fri 18/5/14
So a 3-day, 22.5hr PT is entitled to 5/8 of the 8 days as paid. Those doing set Mon/Tues/Sat for example should get a lieu day against one of the above bank holiday days when they would not be at work, so they get their entitlement of 5 paid bank holiday days.

Re: part time workers bank holiday week agreement
The reason for the complication is that the statutory minimum holiday entitlement is 28 days.lala wrote:Really? If its your day off then you get the day in lieu surely? A new starter in Royal Mail gets only the equivalent of 22.5 days holiday entitlement with the rest of the statutory minimum made up of bank holidays.
If someone doesn't get any bank holiday entitlement because they never work a monday the company would be acting unlawfully so there has to be an adjustment made.
good times, bad times you know I've had my share
