i have had 4 operations since 2010 i have had foot surgery in 2010 &2011 (which atos said i was covered by disability under the equality act,) i was issued a stage 1i then had knee surgery in 2012 and was issued a stage 1as my previous stage was up ,i then had surgery towards the end of 2012 for an operation to try and fix my first problem (so operation 1,2,& 4)where all related and atos also stated for my last op i was covered by disability & equality act my dom issued a stage 2 , iwas under the impression that all related operations are covered by the same stage?i was then told that if it ever got to a stage 3 they would most properly take out the stage 2 as the operations where connected so why was it issued to start with

Interesting, i've had an ongoing condition too that's covered under the dda. even though my record was perfect for a good number of years i've not been able to control this condition with meds and it's been getting worse. Trouble is i've been issued stages all the time with no leeway.

so why was it issued to start with

For 2 simple reasons:
1. To piss you off. (This is what passes for industrial relations in RM)
2. Because your DOM hasn't got the conkers to admit to his manager that he hasn't issued a stage warning when he had the opportunity. They like to think they can use the Attendance procedure as an extension of the Conduct Code.

So if you're off with a reacurring of the same condition, does this count as one stage or is it down to the time off and treated as seperate?

I don't think there is a simple answer to the question as it would depend on the cause of the absence and the length of time between absences.
But any condition recognised as a disability and covered under the Equality Act should be discounted from the attendance procedure. Frequently they aren't quite simply because DOMs do not understand the law or recognise this as discrimination.
