attendance procedure
Just returned to work following heart attack on duty and had my return to work. During the Interview my manager explained that I would being receiving a first stage warning as it was mandatory ie. not open to management discretion. Can anyone confirm whether this is correct.

P13 ... right I will take this further as I dont think that someone recovering from such an event needs this kind of treatment. A member of the public saved me by recognising the event for what it was and called an ambulance. Manager turned up and knocked of the ambulance door only to ask for my box keys - not to enquire about my condition. Where do they find these people? I've had a 3 month layoff with a difficult recovery and will be on drugs for the rest of my natural. I'll take this to my local rep to see if I can get this quashed. Thanks fellas.

Stage 1's are issued automatically at our place but if you don't appeal it then nothing will change.
I will always put an appeal in just to see what motions it starts.
It's always good to keep a record and use the companies own grievance procedures because you have a paper trail
if anything untoward happens in the future.
The cynic in me thinks the appeal will be a waste of time but at least you have tried.
If a tribunal were to get involved at a later date the first thing they would ask is
"Did you use the companies own grievance procedures to resolve your issues?"
Not only that you are absolutely morally right to appeal.
If I read this correctly your heart attack happened whilst on duty.
And the company has a duty of care for its employees during working hours.
You definitely have a case for appeal.

Thanks for all the constructive comments. Maybe I was ill advised to attend the impromptu meeting without representation. The way he explained it to me was that it was not his fault but the system which automatically triggers the stage warning as was suggested by someone in an earlier post. I suppose the management discretion is whether he then formally issues me with the warning which he verbally stated he was obliged to do. Maybe I should wait for him to officially issue the stage warning before I act.
ATOS have stated in their letters to both partys that I will be recognised as diasbled in terms of the Equal Opportunties Act and I asked him what that meant to me in practical terms. He said "not a lot - we can still sack you if you go sick" - nice to know we're a people company. If anyone could provide any advice on this ATOS defintion it would be helpful before I get the pack horse treatment once my rehab is up.

I don't know about ATOS but try local level first.
If each time you are sick it is with the same medical condition this strengthens your case.
Now if you go sick again with a different reason this will strengthen RM's case against you and make it easier for you to be sacked.
You now have a recognised medical condition, this will give you some leeway to manoeuvre should you fall ill again.

I think they are automatically triggered but when you have your official stage warning interview it is definitely at your managers discretion if he issues it. I was off for 5 months after having a back operation an on my return I had an official stage warning letter and was invited to an interview and during the interview the manager advised he was not issuing it.
