Private vehicle damaged in RM yard

Good evening

I wonder whether you guys could give me some advice.

A colleauge went into work on a Sunday when the office was closed to perform collections & parked their car in the yard for security reasons. Whilst out and about a york which someone appears to have left the brake off rolled off the dock and tipped onto the car causing damage to the wing, door & mirror. The dom was approached but showed absolutely no interest and said that company are not liable. Where do we stand? Surely if the person had not left the york lying about with the brake off this situation would not have occurred.

Any advice would be greatly appreciated.

i think privite cars are not covered under the buisness insurance and there for no claim can be taken as the car owner used this area at his own risk.

we have had an incident in our office and the owner was also told this sorry

I think it's a disgraceful attitude from the Dom.

I'd attempt a few emails higher up the chain.

get them to check the cameras and see who left the trolly there and if it was there before he parked in the yard then he can ask the person who left there to pay for the dammage

NO PRIVATE CARS ARE ALLOWED IN OUR YARD, WE HAD AN INSTANCE A COUPLE OF YEARS BACK WHERE SOMEONE CAME INTO THE YERD TO COLLECT A PARCEL, WE TOLD HIM HE WAS NOT ALLOWED, AND IN THE PROCESS OF REVERSING OUT OF THE YARD IN A HUFF, HE CLIPPED A FENCE AND RIPPED HIS FRONT BUMPER CLEAN OFF, AS FAR AS I KNOW WE STILL HAVE THAT BUMPER WAITING FOR IT TO BE CLAIMED.

also last week our DIM parked his can in the yard when we all were out on delivery, a woman parking in there and damaged his car when trying to reverse out

It depends on who owns the land for the car park. If its private/Royal Mail property then I am afraid there is no claim as vehicles are parked at the owners liability not the firms. There should be signs somewhere to this effect, but I don't think it changes anything if they aren't.

They might have a civil claim against the person who left the yorkie unbraked, however as they were acting as an argent for Royal Mail, and Royal Mail usually deny liability because of the above, then the chances of making a claim are slim.

I did notice a disclaimer on the yard gates today, so I guess this rules out any claim against RM. The blame clearly lies with the person who left the york unbraked however the chances of finding this person are pretty slim as I suspect the york may have been left the previous day at the end of shift on Saturday. Also the cameras do not cover the dock area and even if they did the cameras to my knowledge do not record.

I once had a similar incident in a supermarket car park where an abandoned shopping trolley blew into the side of my car causing damage. Although the supermarket were not directly responsible they however paid for the damage. I was hoping that RM would act in the same way but hey we all know what sort of a company that we work for don't we.

All in all, an expensive afternoon for the person concerned after helping out the office & giving up the majority of their Sunday.

You will find a monitor in callers office or similar with hdd recorder. These are able to be rewound to view footage though managers may deny this.

Also this can't be used in any kind of case but may show York dude who left it.

Simply rewind to said time

The car was parked in the yard for security reasons on a Sunday when the office was closed whilst the person was out collecting in a RM vehicle. Private vehicles are not and have never been used in our office for delivery.
