Help required
Basically a manager is trying to dismiss me, for apparantly missing from point of duty 4 occassions tuesday and wednesday for 2 weeks, once before break and the other before shift ends, i just read the notes and basically he is saying he was in my area at that particular time each day he was working, which is nonce but i have no proof, and noones willing to help me, and now my ID card wasn't working for a week or so, on the clock machine i use regularly, he said prior to a fact finding, he will drop the case if i basically just say yeah hes right and i was leaving the premises early, but having worked for 9 years @ royal mail ive never left early, this is a manager who stopped my pay after i had a major car accident, and now i just require help from you guys if possible, he also used the speedstyles, which rules state he can't use at all for a c&c case.. please help me as they are charging it with gross misconduct and dishonesty, please help

Re: Help required
notice from your previous posts that although you say say now that you have never left early, you do have a history of poor time keeping, going as far as being dismissed for being continually late less than 9 months ago, granted you got your job back but your time keeping as you admit was suspect, why would you put yourself in the firing line by continually being away from your point of work?

Re: Help required
What do you work as?
What function do your work in? Delivery? Mail Centre?
What clock machine are you talking about?
I would be very wary about admitting to anything you didn't do.
I've seen this in action.
You admit to it at the fact finding.
They then conduct you for it = using your admission as their evidence.
Unless of course you trust your manager.........
Or if you did actually do it?

Re: Help required
am an OPG
work at the MC
Clock machine where we swipe in and out at duty start/finish time
yeah thats what it is, you admit something you didn't do just because they said they'll bury the hatchet, i will never let that happen, the manager saw me as an easy target, because i've just recently been reinstated in my job, and last thing i want is any more trouble, especially with a major on my record, the managers are looking at me as an easy target, i am trying to keep head down do my work and it just isn't sitting well with the managers

Re: Help required
You need your Area Rep involved - to be honest this is probably too complicated a case to be dealt with by advice from a forum -good luck though.

Re: Help required
the thing is he has shifted to another building for xmas
the manager who he passed the case upto, is giving his decision on saturday,
is there a certain period they must let someone know what the outcome is to a case, or can they take there own jolly time 3-4 months, even saying because of christmas pressure a decision could not be given blah blah
and it is keeping me on edge, and also if the guy in question noticed i was missing according to him why could he not challenge me that day or within 24hours
now i am really stressing, i have just recently won an appeal and now this :( given 2 year serious this is seriously having impact on personal aswell as work life :(

Re: Help required
that is not what i was hoping for "Summary dismissal"
they gave it as gross misconduct, mmm also being deceitful and not correcting my ways which to me is a load of tosh
but any help will be greatly appreciated
i am going to appeal
but the manager who gave the conclusion brought alot of other things to the table, that weren't mentioned in previous meetings
and he also sided with the manager who started the FF
what can i do?
please help
i am also trying to gather if a issue does raise
does a person not need to get the ticking off, written warning, verbal before even contemplating dismissal
or is it in my case because i had a major before thats why they couldnt adhere to that procedure

Re: Help required
If it's gross misconduct they don't need to give you a warning.

Re: Help required
Okay that's understandable
So is there anyone else I should be in contact with or anything
Or just appeal
Also I am still trying to gather how it can be gross misconduct
And the original manager who started the case has done brilliantly to lie, and the next manager done everything to
Agree with him :(
