Sorry - but you knew it was wrong so beyond you not getting a 1 year reprimand what would counselling achieve. Counselling is basically telling you how to do something correctly because:

1. You did not know the correct method.
2. You had not been trained to the correct standard
3. You were not doing the task at an acceptable level.

You quite clearly state you knew you were doing wrong, and no doubt had been made aware of at an WTL. The manager would have been aware of that and had a paper trail to prove it. It has since its introduction been a conduct-able offence to not use the appropriate equipment and a 1 year warning is probably the lowest punishment you could expect.

What you should have done was advise them as per the rules about being unable to complete the delivery and let him make the decision. If the discussion did not produce the results you wanted or they refused to manage the situation then you should have contacted the CWU Rep/Bolshy mate, and got their help.

With Child care problems and "flexibility" a decent rep should have been able to get some of the work covered for you and the manager if he was aware of the situation should have done it without pressure from the rep. Flexibility can be asked for by workers as well management and you could have finished 30 minutes earlier and made the time up later in the week, with childcare issues this would have been an ideal solution for both.

I know that it can be frustrating and intimidating advising the manager when you can't complete and you have my sympathy, but now you can see the pitfalls of making your own decision without authority. My advice would be starting playing the managers by the rules.

It is on your pay slip.
If you don't agree with the manager's decision you can appeal it.
What did your rep say?
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

The P&M2007 agreement and the 2010BT agreement are both in downloads.

Thee 30 minute flexibility with swings and roundabouts is in P&M2007 and the child care issue entitlements are written into law so you could check out https://www.gov.uk/time-off-for-dependants" onclick="window.open(this.href);return false; or get advice from the CAB/Union.

It does state in the WTL brief that it should be counselling for the first offence.

But it would also surely depend on his attitude at the fact finding?

I wouldn't think so unless the member stated that they had no intention of using the correct methods even after counselling and you would have to be really stupid to do that.
The brief is unusually clear for RM and i suppose in our favour.
The first instance will result in counselling, further breaches may result in disciplinary action.
Normally it's the other way round.

Suck it up markus - you've been made an example. I'd wager that's not the first time you've done it - just the first time you've been caught. Hopefully it will teach you a lesson - if you can't finish on time leave in - but still use the trolley.

But does the "counselling" have to be a formal sit down in my office type interview or could a quick conversation at the frame such as "saw you using a pouch yesterday - don't do it again" be considered enough.

Difficult to say but i would imagine to tick all the boxes it would have to involve a paper trail at least to determine whether there were any personal physical reasons why you couldn't use the trolley or whether there were any walk related issues.
