varicose veins under the equality act?

hi
someone i know has had varicose veins and problems for at least 3 years. i have tried to find out if it comes under the equality act or not?
The act says that some complications resulting from this condition ,like cvi or dvt may make it a disability but not necessarily varicose veins.
He has had various atos reports done but they sit on the fence over it and will not make a decision.He works in a mail centre and all management do is rotate him between standing and sitting for about an hour on his duty.He does driving over the weekend and says that this helps his condition but he would like to do it during the week but management wont entertain this.Does any union reps have any knowledge or experience dealing with someone else with this condition and would he be considered to be disabled because of the length of time he has had it and can he insist on management making futher adjustment by going driving.
i suggested to him maybe a grievance might be appropriate, but unless his doctor or atos actually put it in writing that driving will make his condition much better then management will try and get out of putting him on driving .Staff within the mail centre processing are short in numbers and they want him there.

any advice please?

the length of time or the type of condition are not what is looked at when considering whether the individual is covered under the equalities act, its how the condition affects him and what adjustments that would be beneficial to him.

so the fact of having varicous veins for 3 years does not matter its how the condition affects him that is whats taken into account, he needs to get a doctor to make a decision either way, he needs to have medical evidence that driving would be a reasonable adjustment and help his condition if the doctors consider his condition serious enough to be covered under the equalities act.

if the doctors wont make a decision then unfortunately the manager is quite within his rights to keep him where he is

Distribution function come under logistics now so to do more driving they'd probably have to apply for a transfer over to logistics and they might not necessarily end up doing runs out of their current MC, it could be from whatever MCs the local logistics depot covers

I had an operation to remove varicose veins and then continued working for a further 10 years, before Atos medically retired me because of arthritis in both legs. I have just had second knee transplant and hope to be running about soon. Every postman I meet say I'm lucky to have left the job, but I really miss it and my wife misses the wages.
It is still a good job with decent wages. Keep Smiling.
