indoor duties ring fenced, dda not prority

i have spondylisis in my spine and qualify under the dda guidelines, ive tried to stay on delivery but my condition keeps flaring up and now im trying to accept that i cannot perform delivery and driving duties anymore, i have two other collegues who also qualify under dda in my office, we are due for a resign soon and 100% of our duties(including indoor) have changed, the current phg is fit and able to perform other duties but has complained and had the indoor dutied ring fenced so that the disabled workers who are covered by dda cannot fill these duties, weve been told that dda does not outweigh ring fencing and we now face the prospect of medical retirement as the surrounding offices have no indoor duties that we could perform, if we did take the indoor duties there would be delivery and driving duties that the current phg and dom support could take so there is employment for them in our office, we keep getting told that ring fencing like this doesnt happen in other areas, so why is it in ours? its nothing to do with relevant experience because we have all been trained to do the indoor duties, any advice would be gratefull

This is an extract from the equality act

The duty to make reasonable adjustments

The duty to make reasonable adjustments means that an employer is obliged to take all
reasonable steps to remove the workplace disadvantage facing an employee with disabilities.
This may involve treating employees with disabilities more favourably than other employees and
the more positive treatment will not, of itself, amount to discrimination.

I have just been through similar thing - took alot of fighting but your union rep will help and you will win. Just make it absolutly clear that you do not want IHR and as there is work you are already doing for royal mail there is no need for you to take it - it is your job which should be ring fenced not the healthy workers.

Not easy but good luck keep fighting you will get there.

Perhaps you have misunderstood these duties are not ring fenced usually unless they have DDA (Equality Act now) considerations. However, as far as I know they are not in the usual pool for repicks/revisions, they are based on selection and skills.

I think they are in my place and they are known as "Dead Mans Shoes" post, in that you can't pick them unless they are vacant, and they only become vacant when the incumbent resigns, is dismissed, or voluntarily gives the post up.

I may be wrong though lets await confirmation.

What you have here is a clash between a collective agreement(Way Forward) and the law(Equality Act 2010)
My money is always on the Equality Act.

Yes I recieved the same advice from these guys at Royal mail chat - to contact Linda Roy - and she was very helpful to both me and my Rep - write and tell her the full story and I m pretty sure she will either sort it for you or get one of her coleagues on the case.
Dont give up - you should win this one - others wont like it but sometimes you have to be selfish when threatened with IHR Good luck

When faced with being bullied into unwanted IHR you have to stick up for yourself
- nothing to do with the revision - we shouldnt really have to fight to be treated properly but thats the only way to do it it seems

I don't think there's much to read into it other than we have repicks happening all over the country at the same time.
Repicks have always thrown up disability issues.
It's also,thanks to the present Government a far more frightening world outside the workplace if you have a disability,hardly surprising that members will try to hang on to their jobs where possible.
The really worrying trend is the employer's wish to IHR anyone who sneezes three times.

Ah I can see that post could be misconstrued - I was thinking more in terms of someone with a marginal/bearable complaint who could manage a 3.5 hr job and finish task has now been rendered incapable of a delivery even with a trolley or a partner on a park and loop. There must however be a finite number of roles suitable for DDA people surely. Maybe the union should be more aware that what was supposedly an "enabler" for longer deliveries has actually become a "crippler" in some cases and start to look at making RM pay more attention to peoples ability rather than a medical termination of employment.

This post makes me so angry, there is truly a point of interest with the PHG and the ADR, the bit I have highlighted concerns me most WHO SAYS RING FENCING OUTWEIGHS THE EQUALITY ACT?????? as stated Lynda Roy all the way :wave :wave

On the subject of rinfence and dda if a driver is off ill and the is a resign in the office can he request to stay on his duty now he is covered by dda or does he have to accept a duty both management AND union have told him he has to do and they have ringfenced it.? The duty has a lot more delivery points and has not been correctley assessed.!

going back to plantar fascitis i have it quite bad too and same as you have been taken off my duty cos some guy got dda and has said he needs driving job. don,t know what his problem is . but my problem is getting worse by the minute.

also can anyone answer about me being kicked off my job.

also where does this guy go in the re pick order as he is laughing and saying he is going to have what job he wants.

i would also like to point out that this guy works his day off and does evening sa,s too. i thought if he was that bad then working extrra would be too much for him.

surely there must be some ruling on this as he is doing what he likes. i.e putting people noses out of joint by taking there jobs.. still working overtime..

please can someone help as yet again my rep is useless and just goes with the flow .

i really need some answers as to the . job displacement. overtime he does please.

oh and we have a revision coming up soon what a surprise.

That is a pretty big generalization to make and also you or anybody else who voices it to him could be done for disability by perception,harassment or any other disability type discrimination he decides,you don't know his condition,you don't know what he can or cannot do and he's as much right to do overtime or sa as anybody.
Your not a doctor and neither are any of the other people in your works(although I'm sure your manager thinks he is :roll: ) wish people would just think before they post or say f***ing shite like this or just do the job and f**k off home instead or bothering what everybody else is doing. :roll:
