Wilful delay of mail

Hi was wondering if someone could give me a bit of info. If you are suspended for wilful delay of mail, how long from that happening does it usually take for you to either be reinstated or formally dismissed? Do you only get paid your contracted hours while on suspension, even if you have done 40+ hrs for the whole time you have worked for them, over 3 years. And if you appeal the decision would you continue to get paid or would it stop. Thanks x

wilful delay can be construed as gross misconduct which can meen dismissal. you still have to go through the conduct code procedure with a fact finding interview and then an interview proper if it warrents it. if you get dismissal, this usually comes with notice, 12 weeks i think. you can appeal against dismissal. if this is unsuccessful you can go to an employee tribunal, but the union will not take on the cost of this. if you are successful at a tribunal you will recieve what the court percieves is right in payment, but you will not get your job back. all the best

Hi thanks for the reply. This isn't about me it's my ex. So am I right in understanding that once everything is done and he is dismissed ( which looks to be what will happen ) he gets notice of 12 weeks. So he would continue to get paid for the 12 weeks notice period after the decision?? Seems very generous since you've been sacked lol

dismissal normally comes with notice. it may be his case is not normal.

Ok thanks. I have no other info apart from what I've said. I have no idea exactly what has happened, I just know that he has been suspended and what the reason was. Cheers for your help x

i got dismissed for wilfull delay and was sumary dismissed with no notice.

wilfull delay is on their "most serious" crimes list

you will only get notice if its a sickness stage 3 issue 10 yrs service = 10 weeks notice

13 GROSS MISCONDUCT
Some types of behaviour are so serious and so unacceptable, if proved, as to warrant dismissal without notice (summary dismissal) or pay in lieu of notice. It is not possible to construct a definitive list of what constitutes gross misconduct, and in any event all cases will be dealt with on their merits. However, the following examples show some types of behaviour which in certain circumstances could be judged to be gross misconduct.
• Theft
• Violence
• Harassment and bullying
• Abusive behaviour to customers
• Wilful Delay of mail
• Deliberate disregard of health, safety and security procedures or instructions
• Unauthorised entry to computer records
• Criminal acts against the Post Office or its employees

I could ask why are you so interested in me asking the questions? Clearly I have my reasons or I wouldn't of asked in the first place. Since you seem so interested, I have a 5 month old daughter with my ex, and if he's not working he can't pay his child support. So since I know he has been suspended and roughly when, I was wondering on the time frames and will he continue to get paid. Then I will know in advance when he won't be able to pay towards his daughter, which judging by the answers here will be pretty soon. So it's nothing to do with gloating or being scorned I just wanted to know what the situation was.

Ah I can't help how people think it does or doesn't sound!! I'm hardly going to be gloating over the fact he has no job and can't contribute to the upbringing of his kids.
