hi there
i was of sick on the start of feb 2012 and now 7 months later my manager has ask me to attend a interview regaurding my sickness

this seems along time to wait for a interview is there anything i can do or say to the manager about this ( no union rep at our office)

As far as I am aware stage interviews must be conducted within 6 months of returning back to work. If this date is exceeded then the stage or interview cannot be issued, and the attendance procedure for that particular stretch of sick absence becomes void.

My advice would be to contact the Area Delivery Rep for your office and explain the situation. Also ask him, and the manager, to attend the meeting as your witness/advisor.

If the ADR can't kill the stage, if they are a decent rep they should be able to back date it.

If you are issued with a stage it should be from the date of the illness/absence not when you go for the interview.
So you should have 7 months of that done, But as Jaz.d said it's over 6mths and should not count their fault not yours.
Get the Area rep on to it asap.

Here's a copy of the relevant RM Attendance Procedure document attached.

5.2 Missed Triggers ; In the event of a trigger being missed for an absence or a series of absences HRSC are only requird to go back 3 months. Any outstanding triggers older than this will be ignored.

Find out when the Stage was actually triggered and sent out ,some Managers have a habit of leaving them lying in their desks for months . Whatever the date is ,they've messed up and it cannot be issued now.

Also ,as said previously ,get the Area Rep or someone from your Branch involved and do not attend any interview on your own, as there's always a chance the Manager may decide he nows better and issue it. If that happens then you'll have to go down the Grievance route to get it overturned and if it's taken 7 months to issue you with a stage ,then you could end up waiting longer to get your Grievance heard.

I think the replies have already sorted your problem. The overriding factor in your case would be - has the employer behaved reasonably and in your case they have not. Rather than trying to get you to attend a much be-lated interview the manager should consider him/herself lucky that you haven't put in a grievance.
