waiting for reasonable adjustments before return to work

Post by toastie »

I am off work while waiting for reasonable adjustments to be agreed on my delivery. My doctor says I can return to work when these adjustments are in place, and my union rep is sorting it all out for me. Meanwhile things are moving very slowly and I am on sick leave.
Does anyone know if my pay will still be halved at 6 months on sick leave (over 3 years I know, so I must be getting close) even though I am only away because the process is taking so long and they know that is the case ?

You should like every Dr Kildare manager I've ever come across.
No they shouldn't!
A reasonable adjustment is supposed to be designed to what the person can do and should also be risk assessed, theres not much point a colleague being made to come in `on light duties` and then injure himself because some knobjockey wants you to throw out a couple of walks or move half a hundred weight of packet bags if you have a medical condition that could be made worse by doing so.
If you as a person wants to come in and do light duties and your GP and Atossers have said fine as you feel upto it, then fine,in this case though the doctor has advised against it
My doctor says I can return to work when these adjustments are in place,
just don't let management say YOU SHOULD RETURN TO WORK and I can and will find you some work to do as light duties or we will stop your pay bolloxs that they like to spout.

Thank you General you are quite right!!

Trouble is it is taking a long time to sort out and I just wondered how long it would be before my pay went down? - will they stick to the 6 month then half pay rule, or will they extend it because I cannot come back until they have sorted out the reasonable adjustments, which have been avoided for so long until I've ended up off again?

We are now going through the correct procedure at last and I am hopeful the reasonable adjustments will be agreed - eventually!!

Yes they will put you onto half pay after six months that is a given with these turds but.....
Well if they are dragging it out and therefore technically making you lose money by their in ability to implement a reasonable adjustment i.e you will be forced to stay off and go onto half pay if you wanted to take it further then you could s**t them up with this little gem from a tribunal case:

Meikle -v- Nottinghamshire County Council (2004 IRLR 703 CA)

Ms Meikle was signed off work as she was unable to continue in a situation where her employer had failed to make necessary reasonable adjustments to her workplace. In such circumstances, the court found that it would also have been a reasonable adjustment to have continued to pay her at full pay rate, not cut her pay after 6 months absence.

Just mention this to your rep or his superior and watch there eyes glaze over. :dance
