Less favourable treatment of fixed-term employees
3.—(1) A fixed-term employee has the right not to be treated by his employer less favourably than the employer treats a comparable permanent employee—
(a)as regards the terms of his contract; or
(b)by being subjected to any other detriment by any act, or deliberate failure to act, of his employer.
(2) Subject to paragraphs (3) and (4), the right conferred by paragraph (1) includes in particular the right of the fixed-term employee in question not to be treated less favourably than the employer treats a comparable permanent employee in relation to—
(a)any period of service qualification relating to any particular condition of service,
(b)the opportunity to receive training, or
(c)the opportunity to secure any permanent position in the establishment.
(3) The right conferred by paragraph (1) applies only if—
(a)the treatment is on the ground that the employee is a fixed-term employee, and
(b)the treatment is not justified on objective grounds.
(4) Paragraph (3)(b) is subject to regulation 4.
(5) In determining whether a fixed-term employee has been treated less favourably than a comparable permanent employee, the pro rata principle shall be applied unless it is inappropriate.
(6) In order to ensure that an employee is able to exercise the right conferred by paragraph (1) as described in paragraph (2)(c) the employee has the right to be informed by his employer of available vacancies in the establishment.
(7) For the purposes of paragraph (6) an employee is “informed by his employer” only if the vacancy is contained in an advertisement which the employee has a reasonable opportunity of reading in the course of his employment or the employee is given reasonable notification of the vacancy in some other way.
Objective justification
4.—(1) Where a fixed-term employee is treated by his employer less favourably than the employer treats a comparable permanent employee as regards any term of his contract, the treatment in question shall be regarded for the purposes of regulation 3(3)(b) as justified on objective grounds if the terms of the fixed-term employee’s contract of employment, taken as a whole, are at least as favourable as the terms of the comparable permanent employee’s contract of employment.
(2) Paragraph (1) is without prejudice to the generality of regulation 3(3)(b).

Thanks for the replies, the first contract was for 6 months the 2nd was for 6 months, i physically saw and signed these. The 3rd was sent to my manager who came up and said he would like me to stay on as a worker and i just said yes, so to be honest, i havent signed anything and i havent seen the contract so dont know the length of it. I will of been there for exactly 1 year tomorrow (3/01/12).Would it be worth me asking for a copyor just leave it as it is. Thanx in advance

in your case i would leave things as they are
you are still working after your last cantract has exprired so you now have an implied contract of employment with all the same rights and duties as the last one

ah but dos he ? he has a new contract not a ongoing contract, therefor he dont get the same rights as us for 12 weeks. then he be entited to whatever we getting for a new starter. as hes on a rolling six mth contract he may mean that hes entited to not a lot. check your contract you signed up 2

It all depends if you had a break between contracts its based on continuous length of service.

My contracts where this 1st contract 4/01/11 till 3/07/11, 2nd contract 4/07/11 till 3/12/11 3rd contract i dont know. So i havent had a break in service but the second contract was for only 5 months (does this seem right), it never dawned on me till ive just looked at the dates ive put

that is the feeling i get when people ask such questions.thats why sick pay /maternity leave and the like should be scrapped.sick pay only if you are ill /injured as a result of attending work.the rest spoil it for the deserving few.
but i guess i am in a minority of one with this

Can i just say im not doing this to "play the Post Office system". But they owe me 10 days holiday through my days off falling on Bank Holidays and Royal Wedding etc, when ive asked them when i will be able to have my holidays they said they will have to carry them over till next year. So if ihave a week off this year i would need to go sick

I can't imagine why anyone would want our sick pay scrapped, it's one of the few decent benefits we get. Yes, some people do take the piss but why should the deserving many suffer?
