the dom has said the part timers in our office have been given too long for their breaks since the park&loop system came in, a year gone october, saying they,ve been getting 20 mins in the middle of the shift, and 20 on the end. he,s now trying to work some kind of clawback as they were only due 15, then 15 on the end. i mentioned to the rep that if thats the case then then 10 mins they owe from each time it was overpaid could be taken from their break at the end of the shift. i.e take 20 mins break before they go out on delivery, then ''donate'' their remaining 10 min break due on the end. we all just go straight home anyway when we get back at the office to pouch off so they would,nt really be missing out. the rep says it doesnt work that way. he says its a paid break, even if we didnt take our break at the end of our shift we are still paid for it, so it is still classed as time owed??? how the feck can this be right. you can do what you like with your breaktime, its your time. is he correct, if he,s not then i think he,s the doms lackie. and spinning shyte.

I think the rep is saying that as all the part timers did 10 minutes too little work everyday for the passed year , these 10 minutes should all be added up and payed back in unpaid overtime. Daveyeff, I wouldnt even discuss it - managment (maybe with the help of this rep) has cocked-up , tough. No such thing as clawback.

what flaming breaks ..hardly ever get one at our depot ..all time eaten up with doing d2ds ..which add greatly to a walk ..even on light days ..unless your a runner ..no chance..d2ds add at least 15 to 25 mins on a round ..but was that taken into account no ..

Theres nothing they can do about it its the law.
Its seems to me your office does not have enough hours to cover workload
You guys really need to start taking your breaks as you aint doing yourselves any favours,while doing royal mail a massive one

As above, there is always time for your paid breaks (taking account of any extra entitlement if doing overtime above and beyond your contract hours), what is left of your working day can be filled with any reasonable request by management remembering that any overtime is optional if it suits you (including "flexing").

As for the OP, we need more details about the length of working days for these staff to know what their meal relief entitlement is, I'm aware some depots with P&L revisions have staff work 7-8 hour contract shifts three days a week (which would give 40 minutes meal relief per day before any extra overtime entitlement when they reach 9 hours). How on earth do managers not spot an error for a year regards breaks (if they really have been getting extra) and then expect to claw it back? Are the depot managers normally "as honest as the day is long" regarding how they treat the posties?
