Ok im a fairly new rep in at the deep end.

Our dom has decided in his infinite wisdom to begin scrubbing out peoples overtime where he deems traffic to be light and below model week

Got a call today from a rep and he has said to go to disagreement over it


Now I want to get the letter to the dom right

Can anyone offer guidance?

He claims he can due to the 2010 agreement :shock:

I disagree, now before our office implodes I need to nip this in the bud

First call would be to stop doing the docket yes?
I Wrote-During Covid-Which is still relevant now
It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

The overtime should be agreed, in the presence of a witness, before delivery commences.
Failure to then pay the agreed o/t should be a matter of individual grievances.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

as of this morning 57 people were docked overtime last week

My rep has told me to go to disagreement as our dom is now doing it daily.

sadly half the people in my office havent got the sack to put in grievances etc

hence it being at my door

Advice would be to tell your entire office to work to rule, in on time, not a minute before, go for break at a specified time, all of you together, then complete prep and assess whether you will complete, if not, usual guidelines, tell dom with a witness etc etc, but the main one is this:-

NOBODY AGREES TO DO ANY OVERTIME, JUST FOR A WEEK OR TWO, THEY WILL SOON CHANGE THEIR TUNE WHEN THEY ARE OUT WITH THE LEFTOVERS AT 3.30/4pm :)

Advising the whole office to work to rule could be construed as unofficial industrial action and could leave you in the s**t.

If they don't have the conkers to put in individual grievances, then it is no wonder the DOM thinks he can get away with any old s**t.
The rep doesn't have a magic wand if the staff don't have a collective backbone.

As Postman says the first time you have overtime scrubbed out, should be the last time you do it!!

I havent got much more experience as a rep, only been doing it just over a year( but boy what ayear!!)

the terms disagreement and greivance both sound a little more scary than they actually are.

Just politely outline your concerns in writing(there is a standard form aswell) and as part of the IR framework he will have to make an effort to discuss the problem with you and find a solution.

If you can't sort the problem, it will go to a stage two. where area rep and area manager will get involved, by this point someone should have realised that enforced overtime is illegal!!

what facts is he using to base his assumptions on?
have the walks been tested?
Are your traffic figures reliable?

as far as i know it is illegal for anyone to alter your overtime. if a manager thinks you are wrong on the overtime you are claiming he has to talk to you about it and see if any mistakes have been made if not he has to take you all down the conduct line for making fraudalent claims

DO THEY NOT GIVE TRANING TO REPS ANYMORE

THEY CANNOT SCRUB OUT OVERTIME AT THE DROP OF A HAT.

IF YOU BOOK DOCKET THEN THE MANAGER HAS TO TELL YOU WHY ITS NOT BEING PAID, NOT FOR YOU TO FIND OUT WHEN YOU GET YOUR WAGE SLIP

LOOK UP SECTION 13 EMPLOYMENT RIGHTS ACT, UNLAWFUL DEDUCTION OF WAGES.

IF THE DOCKET HAS BEEN SCRUBED OUT THEN YOU PUT IN A GRIEVANCE IF YOU ARE NOT HAPPY. YOU CAN THEN PROGRESS IT TO AN ET1 CLAIM AS 12 MONTHS SERVICE IS EXEMPT IN PAY ISSUES IF REQUIRED.

TELL YOU MANAGER THAT BY DEDUCTING WAGES WITHOUT CONSULTATION IS IN BREACH OF YOUR CONTRACT OF EMPLOYMENT

ALSO

THERE IS NO SCOPE IN THE 2007 PAY AND MOD AGREEMENT TO BANK HOURS

thanks guys

basically dom has shown me traffic figures with model week also.

He is basically saying if anyone booked overtime on a monday then as tuesday is " according to him and his figures " a light day so he figures people will; make time on the tuesday hence scrubbing the docket off.

he only does it if people worked both mon and tues

and now he is telling me the cluster manager for area ( i think ) has said no pressure OT to be booked without his consent :Very Happy and no riddling/cutting off is allowed.

if people threaten to cut off they are to be " councellled and have their mail counted

though it appears they tell the cwu one thing ie all the above is not true then the doms another

DOM is talking codswallop

2007 flexibility agreement allows for 30 mins flexing with hours to be reclaimed same week, get hold of the some for your D.O and if your not happy put proposals to DOM to alter it.

Also consider if your longs and shorts are set up correct, it may be some days need to be shorter and others longer viable is worth while to do. Its been 3 years since D.O's implemented longs and shorts so having a review to see if the 2008 times agreed for your D.O are still suitable would be a good idea.

Flexing can not work backwards so if you flex by 30 mins on a Wednesday you have to be given the time back on Thursday Friday or Saturday, any time made on Monday or Tuesday can not be used.

If your where I think you are then you should have had a A4 sheet full of quality guidance from Sub divisional rep which will confirm the DOM is mistaken or acting on his accord.

That senior mangers are challenging O/T is true as we are in what is traditionally summer lull period so therefore they expect pay and mod 2007 agreement to be used to keep costs down.
