ADVICE PLEASE!!!

I am a postwomen on a cycle delivery and also cover van duties.In January 2011 I was put on a fit note from my GP following the results of an MRI scan carried out on both knees due to chronic knee pain over a period of time. I was only allowed to do office work. My manager contacted ATOS who I had a telephone consultation with, they agreed with the GP's fit note and said they would take over from here. My manager was told to contact them again once I had seen the hospital.
I had an appointment with a knee surgeon March 2011 and he said my knees had alot of inreversable damage and told me I needed both knees operating on. He put his diagnois and long term prognogis after surgery in writing to RM. He's the worrying part " evan after succesfull surgical outcome the patient will be unable to carry on her job as a postwomen due to the damage already sufferd" I gave this letter to my manager.
I had my operation April 2011, and am currently off sick. Also there is the prospect of further surgery and eventually knee replacement, which I need now but am too young (35)
My concern is that my manager said he will only contact ATOS when I return to work. But I can't return to work on rehab long-term (my manager said the office can't budget for indefinate re-hab) and I have not been offered an alternitive. To be honest I have heard from my manager once in 8 weeks.
I have read up on ill-health retirement, which given the current state off RM might not be a bad idea.

have you got a local union rep, or contact CWU head office, the dom will be asking the question can you return back ?
I personally think we have far more cost cutting to go, the loss of meal relief next.
and i think they will get rid of these ill health retirement payments, your health is in a very bad way, listen to what your body is saying.

Hi, thanx for the reply,
I have got a local rep, both he and my DOM have seen the letter from the sugeron and know I will not beable to return to work as a postie. I am still having physio and am seeing my surgeon in July. Do you think I need to arrange a meeting? or is it up to my DOM to contact me?

Yeah 15 years walking the streets, hard to prove RM fault as I have always played sport aswell. Both contributing factors, doc says if I had office job, probably would of started to have problems in 50's, but no doubt RM would fight me tooth and nail

So paying wages to an Employee, negates the Employers legal responsibility to adhere to their duty of care, does it?
Somehow I doubt that. I'm sure I'd have spotted it somewhere in the Health and Safety Act.

Please get in touch with your manager to contact ATOS on your behalf. It's the first step on ladder to IHR. However, if you are still on full pay, would it not be better to let this run out before considering IHR?

Don't let them bullshit you that one about playing sports. Playing sports actually helps keep you fit and able to complete your duty as well.

Thanks for the advice, my manager contacted to say he was contacted ATOS for a face to face consultation. I have told my union rep and he is going to come with me. So it looks like the ball is starting to roll
