I have started the greivance procedure against the management team at our office with regard to them not complying with health and safety law and inadequate safety management. Can a manager from this team conduct a misconduct case against me or will a different manager have to take this on?. The misconduct is regard to an RTA accident on duty. Since then i have found that there is no risk assessment for the duty, we haven't had driver risk assessment training. The H&S rep dosen't get any release time for inspections and updates, we've no WTLL due to absorbtion, and the DOM went out of his way to avoid a RIDDOR by bringing me back to work early on light modified duties.

Short answer is yes they can, they shouldn't but nothing to stop them, but on the upside gives you great grounds for appeal if you don't agree with the outcome

A RIDDOR should have still been logged due to the fact you could not perform your normal duty.

It should. Ive spoken to HSE. They say i can disclose the accident anonymously (even though they'll know it's me), but it's better to ask the employer to do it. I'll give them one last chance to do it themselves, then push the button if no joy. The old bill came to the scene, it was off road in between rural delivery addresses, and said they can see that it was just an accident and i wasn't to blame. Not in RM's eyes though. They should all be in CID this lot.
