Iam currently of work suspended with pay my dsm is trying to do me for fraud i have been doing acting managing and have booked the wrong grade substitution all this cuz i wasnt showed how to do it right i have been overpaid £500 over eight months i have not done what he is saying i have and im facing the sak for it anyone got any advice

to sack you for fraud, they have to have absolute proof that you are guilty of it. if you know you are innocent of the charge, you should have no bother prooving it.,,,,unless of course they are stitching you up. but then again that would still be difficult to do, if, as you say, you didnt do it. good luck.charliebigdick wrote:i did but i was shown by a manager incorectlly

The question is not whether a claim was made but whether a deliberately fraudulent claim was made and that is going to come down to,in the most part...a judgement call from a manager...or "reasonable belief".
Unless he can get the manager who showed him how.....to "fess up" to not showing him correctly.
At the end of the day though no proof is needed to sack anyone.

well you learn something everyday, thanks for that f/t. mind you, in his other post headed 'quitting' he,s talking about handing in his notice. could it be he,s not being totally up front, or just accepting the inevitable. if it was me, and i knew i was innocent and they sacked me on reasonable belief', i would fight them all the way.

But surely the very first claim form where you were shown how to do it will be available.
i.e. you've filled them all out exactly the same. Consistency would support your case.
They'll have to interview the bloke who showed you how to fill it in. Then compare his testimony to the evidence of the first form.
And £500 over 8 months?
Thats £62.50 a month, or about £15 a week. Not really a lot, and you claimed the wrong grade for substitution? So were you acting in an ML5 role, but claimed ML4? Or have I misread anything?
