they say it should've been a stage 2,now stop me if i'm wrong but on issuing me the stage 1 last month it clearly states that i will be issued a stage 2 if i fall below minimum sickness standards blah, blah blah, but i'm still on rehab,i was issued the stage 1 AFTER i was sick
the sickness printout that has accompanied my stage 2 letter makes no mention of the stage 1 from last month, but i have a copy of the interview notes, plus the stage 1 plus the printout showing stage 1 trigger
Have i got a case for fighting the stage 2 ?

Re: stage 1 issued,HR says mistake
If a stage 1 wasn't issued it will show on your record as not issued (but will still show up) so how can they issue you with a stage 2.
Just because you have fell below the agreed figures doesn't mean they can issue a stage 2 .
Surely you should be looking at a stage 1 again when you say your on Rehab i take it you have an ATOS report plus a report from your doctor.
One last thing you have consulted with your rep on this matter havnt you and he is sitting in on your interview.
My bet here will be nothing will come of it but the way R/M operate now you can never be to sure.
You can not fight a stage 1/2 until you get to a stage 3

I was under the impression that whilst you can't appeal stage 1/2 you can prevent a stage 1/2 if there is justification not to get it, such as having had an accident on duty which as triggered the stage. Please correct me if I am wrongExrep wrote:You can not fight a stage 1/2 until you get to a stage 3

Femrep it was my area rep who told me about the appeals so not sure whether hes right but i would follow his advice.
An AOD would still trigger a stage 1/2 but again this should not be issued if it is the case and should show on record as not being issued.
Its about time every D/O and branch sung from the hymn sheet.
There is no appeal for stage 1/2 simples once again another issue in favour of R/M.

If the AOD has not been investigated which they usually aren't then they can't balme you for the accident so the AOD gets thrown out and is discounted on a stage.
Most muppet managers do not investigate,so demand it's thrown out.
It HAS to be investigated by law!!

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

The daily grind of having to argue your case with an intellectual pigmy of a line manager is physically and emotionally draining.

If an accident was investigated and it was not your fault then they can't (Shouldn't)issue you with a stage warning if it triggers one.jimmypops wrote:I have a case where the accident was investigated and royal mail accepted liabilit and a stage still got issued, where do you think i stand on that ?????? thats not rhetorical by the way, I really need to know !!!!POSTMAN wrote:If the AOD has not been investigated which they usually aren't then they can't balme you for the accident so the AOD gets thrown out and is discounted on a stage.

In what way do you mean RM accepted liability.
You need to flag this to your ADR ASAP!

Re: stage 1 issued,HR says mistake
Seems to me that there are great variations between the text of the RM Attendance Procedure and the Parcelforce Attendance Procedure.
Parcelforce Attendance Procedure - excerpt:
If the employee is absent as a result of an assault on duty or a bomb attack such absence will be discounted where there is reasonable evidence to support the incident. The same view will be taken towards accidents on duty so long as they have not become representative of an employee's normal behaviour. There are two important points to have in mind:
The first is 'reasonable evidence'. This means that the line manager must be convinced that the incident took place. If it was an accident on duty (and this includes an assault on duty) it must have been entered in the accident book and reported to the line manager at the time of the incident. The line manager must have investigated the accident at the time it was reported. If there is no evidence to support the incident and it was not reported a line manager may count the absence.
Secondly if an employee suffers a succession of accidents on duty there will come a time when they become representative of their normal pattern of attendance at that stage the line manager may count any such future absences towards the procedure. Although not essential, it is recommended that such employee's are warned when this stage has been reached.
