The difference is in the complaint/investigation. Penalties would always be awarded under the conduct code anyway.
In terms of amount of mitigation, at the end of the investigation, whether done under the conduct code or bullying procedure, you would be invited to a charge interview to offer your mitigation.
Neither method requires absolute proof - it's not a court of law - all that is needed is the reasonable belief on the balance of probability that whatever is alleged to have happened, happened.
