STAGE WARNINGS/CAN ATOS OVERWRTE SICK NOTES

I ve recently been of work for two months atos keep on trying to overwrite my sick notes and I have triggered a stage 2 not been given yet as I am off sick the stage 1 is due to expire do I still get my stage 2 if stage 1 given 12 months ago yet i havent been given the stage 2 yet as i havent had a interview is this the reason atos attempt to overwrite sick notes and declare me fit for work even though my doctors dont.

No....you have already triggered the stage 2.
It doesn't matter how long you are off sick now.
Remember though just because you have triggered a stage 2 it doesn't mean it will be issued.
ATOS will always try to get you back to work....that's their job but your Doctors advice overrules anything.

PS the dom threatened to dismiss me when I went off sick on the grounds that I was abusing the sick procedure this was witnessed
can they force me back to work/stop pay
Atos report doesn't state medication or abilities eg stand, sit, walk for no longer than ten mins

Ask to see the report...if your not happy with it ask for another referral.

This is bad...flag it up to your rep,check out your witnesses..get it down in writing if possible but sit on it for the moment..it will come in handy later.

They can try but if you play it by the book and follow your doctors advice to the letter there isn't much they can do without digging a hole for themselves.
An ATOS report is just a recommendation...that's all.
All this added stress can't be helping your recovery much can it.

This is bad...flag it up to your rep,check out your witnesses..get it down in writing if possible but sit on it for the moment..it will come in handy later.

in what way would this come in handy later ?
any advice would be really appreciated

if the atos way of diagnosing people ever went to an employee tribunal it would be ripped to shreds, how the hell can they diagnose someone acurately with a phone call ? , when my partner got ill health retired he got 3 telephone diagnoses before a face to face, like previous posters have said, they cannot over rule your doctor/specialist , unlike atos they do not have a hidden agenda
