Can someone tell me, what is DDA and is a rotary cuff injury covered by it.?
I have a rotary cuff injury , been suffering for over ten years . im awaiting a operation which could take months but have often been told it could be a case for DDA as its caused from the job i do.

I'm sure it won't be covered under the DDA , but if the injury causes you problems with your job you can ask for light duties or modified duties through ATOS

from april your gp can tell employers what work you can do on return and get your rep to look into this as an operation could reduce how much you can do in your current position, not sure about dda but rep can find out from area h/s rep. The DDA as it was explained to me means that if you have a medical condition which impacts on your work but can be controlled by medical aids or medicine then you can be registered under the DDA.
RM then have a legal obligation to consider any aids or adaptations to your duties or workload to assist and DOMs are advised that any absences under the condition should be disregarded in terms of the Attendance procedure.
Ask your DR whether your condition is covered.
RM may be pursued under the Employment Tribunal if the do not abide by the DDA

The definition
For the purposes of the Act:
substantial means neither minor nor trivial
long term means that the effect of the impairment has lasted or is likely to last for at least 12 months (there are special rules covering recurring or fluctuating conditions)
normal day-to-day activities include everyday things like eating, washing, walking and going shopping
a normal day-to-day activity must affect one of the 'capacities' listed in the Act which include mobility, manual dexterity, speech, hearing, seeing and memory
Some conditions, such as a tendency to set fires and hay fever, are specifically excluded.
People who have had a disability in the past that meets this definition are also covered by the scope of the Act. There are additional provisions relating to people with progressive conditions.
The DDA 2005 amended the definition of disability. It ensured that people with HIV, cancer and multiple sclerosis are deemed to be covered by the DDA effectively from the point of diagnosis, rather than from the point when the condition has some adverse effect on their ability to carry out normal day-to-day activities.

This is not the case with RM i'm afraid. RM treat dda absences the same as any other and go through the disaplinary procedure route. We've got a guy at our office that's had 5days sick in 8years, then had a long dda absence due to a condition and given a stage warning.
RM storm trooper managers say, " DDA is not a get out of jail free card".

Hi Postal , not this old sausage again, lol This is part of the national agreement and if your DDA sick leave is counted against you and even worse you get a stage, then you need to act and find out why.
Absences which are incurred by employees who are disabled in accordance with the Disability Discrimination Act 1995 and which, in the view of the Employee Health Service, are related to their disability, will normally be discounted. However this may not always be the case and the following should be noted: · These absences will still be recorded on the employee's sick absence record. · The line manager will still carry out return to work discussions, explain that the relevant absences have been discounted and discuss whether assistance from Employee Health Service or Royal Mail would help with disability-related attendance problems, including consideration of any reasonable adjustments. · Absences which are disability-related may be counted where it is justifiable to do so and in these circumstances the employee should be given advance warning that future absences will no longer be discounted

Wish that was the same for me. I've been took of my duty and treated as a leave reserve. My manager only tells me at the end of the week what i'll be on the next. So it's hard work coming in on a new duty every week doing d2d's and inward sorting plus getting back on time. Last week i tried to work my contractual hours and told they're was nobody to take what i left out so tough. Then i tried to work my contracted hours the next day and was told the same. I pushed it and got three maangers round me. One said, "give him a stage warning", he can complete on time. Anyhow's finally they got someone to take some out.

An out and out cast iron case on Bullying hand harassment in both cases, but even worse it was a group effort on the second occasion.
