Claiming O/T over and above Delivery span

Post by music4essex »

I need to have something clarified

I went over my delivery span by an hour and 15 mins which as far as I am concerned went into my meal relief time of 40 mins

I claimed 1hr 40 mins, today got called in the office to explain why I claimed that. when my duty time is 8hrs

we are on long and shorts though i was led to believe this was only for the summer period.

My gripe is this as far as I am concerned my delivery span is 3hrs 10 mins with 10 mins to and from delivery point
my manager is saying 3 and half to include still delivery letters, then return to office.

2. If you are on long and short does this mean on long days, then you should go over the walk span because this is time that you are being paid too?

3. D2D are these meant to be done in works time including prepping them,

Any advice would be grateful, today i went over by 45 minutes but never claimed as my manager was in the office when i went back and said I was still being paid. so i said I would get clarification on this, knowing i was coming on here to ask

Regards BTW Fulltimer 20yrs

Quick question, to clarify, did you work 9 hours 15 min with no break, then claim for 1 hour plus break as your overtime?

As far as I understand it...the walk span is agreed at 3 hrs 30mins. If you finish before that , on return to the office they should find you other work to do until knocking off time. You should not exceed the agreed delivery time, be it a long day or short day.
3. D2D are these meant to be done in works time including prepping them,
As mandelsons toenail said. 20% per day within duty time, be that before you leave or when you return from delivery if you have time.
Any advice would be grateful, today i went over by 45 minutes but never claimed as my manager was in the office when i went back and said I was still being paid. so i said I would get clarification on this, knowing i was coming on here to ask
If you went over the agreed delivery span (3hrs 30 mins) by 45 minutes but were back before your knocking off time(which i can't believe you could have been) then you've not got much hope...
If you were back after your knocking off time...then you should be able to claim overtime... (note I say should,,,good luck trying to get it in the current climate).
You should always take your 40 minute meal break before you go...It's your entitlement.

As a matter of personal interest...how do they work the long and shorts at your office.
Down here they just alter the start time...
6-2 Monday
6.30-2 Tuesday
5.50-2 Wednesday- Friday
6-2 Saturday

It's all to do with that half hour flexibility....
Instead of giving ours back at the end of the week....which would be near impossible in our DO without quite a few cut offs...
They make us start 10 minutes earlier on Wednesday through Friday.... then give it back to us on the Tuesday by having us start half hour later at 6.30.

From Pay And Mod deal

Longs and shorts – a structural change where the normal work pattern may be rebalanced across the week to reflect the traffic profile. For example individuals could be scheduled to work 7 hours on a Tuesday and 9 hours on a Friday. Total weekly contractual hours would not change.

clock out each day and total up your hours worked at the end of the week, if you have gone over then ask when you can claim them hours back or book some docket. If you dont take your meal relief then thats your fault. It is a legal requirement that you take your meal relief somewhere in the middle of your duty as it cannot be taken off at the end.

So you are not on a 40hr week then?
Does the 7 hour 5-1 Monday include daylight saving?
Confused? I am

right from that, you mentioned longs and shorts so from your 8h45 deducted the duty length for that day, ie 8hr15, so you have worked 30 minutes over time and can claim that on a docket, now not sure if you counted your meal relief in your 8hr45 figure if not add it on and you can claim 1hr10 if you were on a 8hr15 min day,

what i am getting at is even though your duty is 3hr30 outdoors and rest in doors plus meal relief, if you worked 5hours outdoors, 1 hour in door + 40 min meal relief ou worked total of 6hr40, you cant claim 1hr30 overtime for working more than 3hr30 outdoors as you are still within your total duty time, its only when you hit the total finish time you can start claiming ot, and always remeber to make sure you have either taken your FULL Break, if not add it on to your actually finish time to get the true finish time

You are on a 40hr week yes.

But it does bring up the problem of rest days, depending on what your rest day is you could i think work either over or under 40hrs.
Can anyone shed some light on the above?

as i understand it you can't claim full meal relief as you must take a 20min minimum break before you leave your office
