LM handed me a letter from the DOM this morning asking me to give consent to attend ATOS Dr as I'm being considered for another Stage 3. I recently attended a Stage 3 interview due to an AOD which was reverted back to a Stage 2. A couple of weeks ago I caught Swine Flu, diagnosed via the NHS Pandemic Hotline, prescribed Tamiflu. Due to not wanting to go sick I had to try and work until the 2nd week of the illness I could barely breath and had to go home sick from work, I asked Ass DOM if this could be taken from my A/L he said 'No'. I took 3 days off. Now I receive this letter as they are 'considering the Stage 3 attendance procedure' I've just about had enough of all this s**t now and on the verge of balling my eyes out. What can I do? Spoken to my rep who said we will sort it tomorrow, but RM seems to have it in for me.
I know I've had a lot of Stage 3's but all beyond my control AOD, Depression from working in Callers, Operation, Blood Transfusion, what the hell am I meant to do

talk to your cwu rep if that fails i would seek legal advice outside the royal mail i would tell your dom that your going to a solictor and put a grievance in against your dom do that tomorrow please dont let them grind you down thats what they want there is a lot you can do this is just another case of Bullying and harassment at work

This certainly sounds like a rough deal for you, firstly, since the date of the st3 interview where it was bumped down to ST2 , how much time have you had absent? When already on a ST2 you have 2 separate abcenses or 10 days before you trigger a stage 3. If you havn't exceeded the "2 or 10" then they cannot even consider a stage 3.

Taking the Swine Flu into account, although it seems RM will not discount the illness despite govt advice to the contrary, I would think that just in relation to the fact that you risk spreading it to others if you come to work, an industrial tribunal would take a very dim view of any attendance procedure warnings connected with Swine Flu.

In addition, if you have been having treatment for depression for 12 months or more then you should come under the DDA rules whereby employer has to make reasonable adjustments .

If you get your Atos interview (prob over the phone) TELL THEM EVERYTHING YOU CAN ..... lay it on thick, as they say, don't be afraid to mention the depression as that is important.

See your CWU rep as soon as possible, if not in the union then get joined up pronto if you want to stand a chance.

I've had 1 absence of 3 days because of Swine Flu, I am going to try and appeal against the previous Stage 3 that was reverted back to a 2 as it was an AOD and I've now received a letter off the DWP stating that it was an Industrial Accident

You should not be facing a stage 3 if that is all the time you have had absent, either your manager doesnt know the standards or he is trying it on, I would take out a grievance, and IMPERATIVE get union assistance, if your shift rep doesnt deal with this then I would go to your area CWU rep .

Well I agree with both of you sort of, though RM can be pummeled into making adjustments if one is lucky, but the law (which I admit RM think they are above) is quite clear that if reasonable adjustments are refused , in event of a tribunal they would be guilty of discrimination. I went through a very similar experience due to arthritis and the effects of its medication (low immune system) and actually succeeded in getting some absence discounted, with the help of a superb union rep, so it isnt impossible, though not easy, I admit. Like I said anyway in my reply to Stormproof the amount of absence since the stage2 reversion date does not warrant a stage 3 interview, to my best knowledge that is.

My rep has'nt had chance to see the DOM yet, hopefully he will tomorrow. I asked my rep this morning about going down the grievance route and he agreed. When I was diagnosed with depression it was 'reactive depression' according to my dr., bought on by working alone in Callers with no support from management. I feel fine now but am getting very stressed out with all this stage 3 business. Luckily I have a good rep who has supported me through the past couple of years of cr@p i've been getting off management.

I saw the DOM just as I was leaving today, asked him why/how another Stage 3 could be triggered, he said the sickness I had in July (3 days) related to my AOD in January was still live, even though the 3 days in July triggered the previous Stage 3 I had. Now having an absence for Swine Flu its triggered it, too be honest it sounds like bullshit to me, how can the absence in July still be live if that has already been dealt with under a previous Stage 3. He told me in previous Stage 3 interview if I get another one I'm out. I've had enough of this fuc*ing company I hope they sack me now I will take them to an ET.

Did'nt have a clue what he was babbling on about, I was never very good at the Krypton Factor He did tell me that if it had of been triggered he would've sacked me this time without consideration. He also said that his job is more important than mine, don't know why he said that, by that time I had started to glaze over

Jesus ! - ticked a wrong box , the irony is that his superiors would come down hard on him if you took RM to tribunal ( the "loose canon" ? ) , no matter how much they wanted you down the road - hence all the face saving waffle .

There'll be a Mexican stand off now for six months , 1 years - 2 years or more ? - who knows & there will be always some "bright spark" out to make a name for him/herself .

The reason is his job is more important than yours TOO HIM it is his and he can get his arse kicked by his boss for not getting you down the road!. But having said that all your relevant factors must be applied and they were not IN YOUR CASE AND AS SUCH HE CANNOT TICK THAT BOX!.

i would still put a greivence in against him .just to cover yourself saying he put you under imense pressure fo fear of losing your job .then finding out he had ticked the wrong box
