RE: Process changes to the Letters Conduct Code
We have recently received information from a branch indicating that RML have made two process changes to the conduct code procedure. These changes went live from Monday, 29th September 2008.
The first process change is when a manager sends out the formal charge letter. The manager will now need to access a central formal charging database and enter brief details about the case. When the details are saved, a reference number will be given. When the case has been concluded and a decision has been made the manager will need to access this database again and update the entry. The business believes that this process change will allow it to better identify the number of conduct code cases currently taking place. From the information we have received it seems that the database being used is purely for statistic gathering and there is no reference to individual’s names. If a penalty has been awarded, this will be separately recorded as usual.
The second change is in respect of the manager’s decision record. This new form will allow a manager to note down bullet points and summarise the reasons for and against awarding various penalties. It is to help the manager ensure that the penalty awarded is appropriate given all the facts of the case and mitigation. The manager will not supply this form to the individual concerned but will still have to supply the reasons for their decision in a notification letter as normal. It is our view that if an individual appeals against any such decision in line with the current conduct code procedure management will have an obligation to supply this form to ensure our members have received all of the relevant information.
We have not been formally notified of either of these changes by the business and we have written to management seeking an explanation. Branches should make all representatives aware that when individuals are seeking information for their appeal that they ensure management supply this new form with the pack. A further LTB will be issued when we have received a written response from the business.
