Can you go against OH recommendation?

Post by deristrong »

After 6 months off with heart problems then a shoulder injury I no longer get SSP. OH have said I should stay off for another 4-6 weeks and then have a phased return. I simply can't afford this. Can I simply go back to work? I've applied for ESA but that could take a good while.

Yes of course you can. A phased return is a good idea though

The only people that can overturn an OHS report will be a medical specialist practising in your area of illness. In your case will be a cardiologist. In this example, you will probably need a chit from your specialist/GP saying you can return to work on a phased return. Royal Mail will be negligent if they did not follow this course of action.

If you want any sort of adjustments from your normal routine/duty then you would need a fit note that’s says you may be fit to return to work with adjustments WITH THE AGREEMENT OF YOUR EMPLOYER.

No fit note would mean full return to duties with no ability to refuse to do the work/reduce performance as a result of a medical condition.

Your health is the most important mate, don’t go back before you your body actually can.

So. I returned to work this monday on a phased return as recommended by OH and my GP. Do I need to work every day for less hours or work some of the week as long as I've worked the allotted time? Thanks.

I started on 3 hrs a day 5am till 8am for a couple of weeks, then 5am till 9am etc, then after 5 or 6 weeks I was up to 5hrs days and then back to normal. To be fair my manager was pretty good about it
