Off sick or medically suspended or something else?

Post by crazyshrew »

Heat wave!!! What a miserable time the last few days have been, didn't need this added stress.

Underlying health conditions make working in high heat (roughly 27/28° and upwards) very difficult for me, chest pains shortness of breath etc. Easily resolved normally with a few minutes rest and slowing my pace to keep the strain on my heart to a minimum.

The last couple of days have obviously been beyond what we would consider high heat. Chat with (not the usual) manager first opportunity on Monday and I stayed behind working indoors. Plenty of meaningful work I was able to do to fill my hours, such as covering CSP, prepping walks that were not going out.
Tuesday I go in expecting to do the same again, and indeed I carry on as I did Monday...except a number of colleagues have suddenly got medical degrees and decide that I should not be in work and come back and forth repeatedly telling me so.
Soon the same (not the usual) manager calls me in to the office, sits me down and says "you're going home...you're not fit to be at work"

Now then...I'm knackered from the heat, which has probably made me more unreasonably effed off than I would be with the people who know just the headline of my condition, deciding they know more about how I should manage it than I do.
And flabbergasted that a manager in an understaffed, high sick leave, DO is sending someone who is willing and able to carry out meaningful albeit different to usual work, home.
So I sit stunned for a bit, say OK because I have a very bad habit of doing as instructed, and go.
I wasn't even out of the house for an hour!

Today I go in as normal. It's a different (not the usual) manager.
I'm called in to the office to have a welcome back meeting due to me "going home sick" the day before
I stop him right there and point out I was sent home because people decided they knew my health better than me.
The meeting is swiftly ended, he said something about it not being fair to do it as I would be officially recorded as sick when I wasn't. Which would land me with a stage 1, which will then easily snowball to a stage 3 due to a couple of operations I'm waiting for.

So, my question is what should I be insisting this enforced absence be put down as?

How far into the shift was it that you got sent home? Not sure but I believe that if it's past a certain point in a shift then it doesn't count towards a stage

Approximately 40 minutes.
But why should that matter when I was sent home, not sick.
It has occurred to me that this may be a manager covering his arse *before* a potential event.
That is to say, *if* I did fall seriously ill such as fainting, or worst case scenario cardiac arrest. It would not be on RM time so not his problem and doesn't have to do the paperwork.
Which is kind of fair enough I suppose

But...

I was NOT sick, I did not choose to go home, I was sent home because someone decided I should not be at work

• Part day absences will not normally be considered. If the number of part day absences has become excessive, the matter will be discussed with the employee in line with the principles of this procedure. Further part day absences may be counted against the attendance standards, following written notice in advance

There is no set time to be at work to trigger the part day absence as long as you have signed in is enough. If the manager tries it on ask him where the time limit is mentioned in the attendance agreement.

There is no sick absence to record with attendance standards

Update.
Regular manager is back, called me into the office and asked why I'm down sick, Tuesday through to today...I've been in and completed full delivery Wednesday and Thursday!
I explained, he has deleted the absence completely :thumbup
