Overtime before being sent home

Hi all

Got a mate whose a part timer, 9am starts, who came in to prep at 0644 as he usually does. Since then an adverse weather warning has been put in and the office is sending everyone home at 0830. His line manager is refusing to pay the OT he done this morning since hes not going to be working the rest of the day. Is this allowed? it seems pretty dodgy to me

If he was asked to come in, as in it was previously arranged and he had permission to do so then he should be paid for any work outside his contracted hours.

If he came in of his own accord expecting to get paid, and even if this is what normally happens, then he is on dodgy ground.

To get it paid he needs to speak to a rep and think about putting in a grievance, He probably won't get paid without a fight,

As above reply by tbt that sums it up just great and yes it's a bit crap, they did the same at our place last time it snowed and we got sent home, didn't pay the overtime to part timers starting early on prep etc, obviously the full timers didn't get their pay reduced either

This is yet another example of no national agreement to give clarity as a point of reference

My opinion is that as overtime is in excess of contracted hours, there is no liability to pay. Though would expect the employer to pay for the time you are actually on duty.

This highlights the unfairness between F/T and P/T colleagues.

Because Royal Mail, do NOT want to offer F/T contracts, MANY P/T take on additional hours in order to earn more pay. However, whenever there is an event such as this, it is the P/T colleagues who suffer, as the F/T does not lose any pay.

Hopefully the local CWU will be acting on this and overturning the DOM's decision.

They asked him to come in before his start time so thats overtime! Should find out if anyone else that started early got paid! It will be double mail tomorrow so no doubt they have already asked him to come in early tomorrow and maybe help them out with a bit of overtime. If I was him I would refuse to do anything extra tomorrow out of principle.

we got sent home xmas due to snow and we all still got paid overtime
