Break time

Post by ViperF »

So I’m on lates this week and do 6hrs a day. I’m on 7-7 contract so I start at 13:00 and finish at 18:30 taking off my break at the end. Managers are saying you should be coming in at 13:30 and finishing at 19:00 because they are taking my break off at the start of the shift!

Legally that is wrong.

Legally you can't take all your break at the end of a shift or the start of a shift

Technically no it is not wrong. The law says: https://www.gov.uk/rest-breaks-work
Rest breaks at work
Workers have the right to one uninterrupted 20 minute rest break during their working day, if they work more than 6 hours a day. This could be a tea or lunch break.
So if you are expected to work more than 6 hours the rules apply, its a grey area if you are going to work exactly 6 hours.

Attendance length............total breaks..... probable/possible pattern

Less than 2 hours 30 minutes none (a 10 min grace break should be provided if work permits)
2 hours 30 to 3 hours................10 mins.................. 10
3 hours 1 to 3 hours 30..... .......15 mins....................15
3 hours 31 to 4 hours 59..... .......20 mins.................. 20
5 hours to 7 hours................... 30 mins...................30
7 hours 1 to 8 hours 59..... .......40 mins..............40 or 20 + 20
9 hours to 10 hours 59...............50 mins................30 + 20
11 hours to 12 hours 59..... .......60 mins............. 40 + 20 or 30 + 30
13 hours or longer..... ..............70 mins..................40 + 30

Breaks at the beginning or end of attendance

Where an attendance is provided with more than one break, the second break may be scheduled at the beginning or end, in which case attendance is not required solely for booking on or off.

A single break should not be scheduled at the beginning or end of the attendance.

Way forward.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.

The daily grind of having to argue your case with an intellectual pigmy of a line manager is physically and emotionally draining.

You should be starting at 1pm, having a 30 min break somewhere in the middle and finish at 7pm.
