I'm sorry but this is the bit that starts to raise alarm bells. Staff are entitled to a private live outside of RM, one which the business does not encroach into or have any right to information about (safe for the obvious). A single man with no ties has the same right to work his contracted hours as one with 8 children (all of whom have to be picked up from different schools). To even suggest that staff members need to start providing reasons and provide some form of evidence as to why they do not wish to work over is a form of intimidation ... black books may not really exist in desks drawers but they certainly do in the minds of some Line Mangers & DOMs.
Spot on mate.

I offered to flex once but the offered me the 30mkns back in the morning I said no sorry I'm giving it to you at the end so I want it back at the end another day, they need te favour but try to give us the crap end of the deal.
What Bob Gibson needs to do is confirm if flexing is compulsory or not or is it an offer of flexible working that you can choose to accept or reject on any given day without any consequences if you reject the offer.

Employment law says an employer can not force an employee to work over their contracted hours unless it states its compulsory in your contract.I don't see the word compulsory in the agreement.

You have to ask if the CWU/Gibson cant clarify how this is to be implemented in a point of clarification then what are we paying the f***ers for.In my area they have been banking hours on and off for years and now theres been instances of 'punishments' dished out if you don't flex up on any given day-ie; you didn't flex up last week and now its a light Monday and everyone that flexed up the previous week gets to go home early while work is 'found' for you to work your contracted hours. On top of this if you have kept 20 mins M/R to take at the end of your duty you cant sign out 20 mins early but have to sit in the canteen for 20 mins then sign out.
Totally agree.

However if staff only want to work their scheduled hours they should be able to submit an opt out form.

If true, they'd better have plenty available.
Sometimes, I wish I wasn't a Rep.
