RM can afford to take their time as you are not being paid now.

If you can compare two exact cases and find they were not treated the same then this is a really good argument for unfairness plus the fact you were not councelled, the conduct code specifically states councelling is the first course of action.
However claiming docket and being at home is theft unless you can argue a manager told you it was allright to do job and knock.
Best angle is the way you were treated differently to someone else IMO and to argue it was the norm at your DO with other people doing it and not being challenged.
Definately put your Employment tribunal form before the three months runs out from your date of dismissal. Don't put it off.

Get one from the Dole Office or Job Centre and get round to the Branch , the Branch Secretary or one of his Area Reps will help you fill it in properly & it will have to be done right . I'm getting the impression RM have been lurking on here ( quell surprise ) - otherwise that appeals manager wouldn't have said what he did BUT he's only covering his arse from higher up

I know it's not allowed and probably illegal but a voice recorder is allways a good thing IMO. Im not sure re NI about certain things except its an IT over there .............Sharon if you have a CAB in NI go in and get an appointment its free do it ASAP
Fill in the IT/ET1 form online its the best and the quickest way to send it.
Ring up ACAS asap
Consult with the union but if its not moving quickly procced with it yourself

The bit about RM's solicitors ringing up and making offers to drop Tribunal cases because they're " good lads " and gradually putting the offers up by £500 a time is what I've heard when some staff have been sacked for wilful delay on the flimsiest of pretexts .
They tend to offer more if the local rag has got a sniff of it . At one time the local rag would be tomorrow's chip paper but now the Google Spiders will find the reports . Staff on here think it's cheaper for RM than paying for Solicitors / Barristers to represent them at a ET & it keeps things down .
A settlement does not clear anyone and it could be regarded as a form of subtle bullying as RM might hope that somebody doesn't fancy the stressful experience of taking on RM and will bottle it and it could be regarded as a cheap way of getting rid of a " troublemaker " .
There would be a few women's magazines that would be interested in Sharon's story , things could be " manipulated "
but it could work against her i.e. " don't touch that troublemaker with a barge pole " with future employers .

correct - the Social have a separate adjudication unit which will make inquires into your sacking . That's why you need a IT application in as something in black and white to back you up . Also any paperwork re appeal will back you up too .
They may hold fire on putting a sanction on as a result .

The Social will want to know why you haven't signed on already .
When the Social make inquires to RM , whoever answers has to toe the RM line as everything is purely to impress a more senior manager - all this we must sing from the same hymn sheet that you get everywhere but RM take this to extremes .
However this where you can trip RM up as it's likely there will be gaping holes , things will be contradictory etc in their response .
Basically you have to say to the Social why RM have botched your sacking , RM will get to know about it but don't be intimidated by either the Social or RM . They may back off but everything has to be precise , who , what , when , where whom etc blow by blow stuff in order .
DO NOT get into a row , as there will be people looking for one - stick to your guns firmly and politely
There will be managers that will not like you telling tales out of class about RM to the Social so expect them to play dirty

I think ? if they are of the opinion that RM deliberately said something that was never to be on the record or to be witnessed , covert recording would be the lesser crime .
Let's just say some rogue managers have gone white as a ghost when they've found out things have been recorded . RM will naturally squeal like a stuck pig though .

well im going into my fouth week now waiting on an appeal 4 reinstatement if sucsessfull am i entitled to back pay and wot would be a reasonable relocation as im pretty sure im not gonna be going back to my old office
