Drivers in need of help and a warning to other drivers !!

Yesterday at 18:00, DHL delivered my new phone, great I was in, I had a chat with him, he said, he was working 10 hours that day, he was on less pay than we are, didn't have a great pension, and sick leave pay was a pitance, yet we complain.

DHL delivery/driving work, 10hrs a day or not, is nowhere near as demanding or damaging on the body as RM foot delivery work. If we are paid a bit more then I'd say that was absolutely fair.

By your reasoning we should accept poorer and poorer employment conditions just because as others suffer them? That is absurd.

And i'm sure the DHL dude would complain if his firm started to make him drive more and do more work for his pittance pay,or slash his already pittance pension,or cut back on the poor sick pay.

The driver risk assessment also applies to people who currently use thier own vehicles as well as van drivers, we were told today in WTL

I have phoned acas on this matter, they have said if it's not in your royal mail contract to sign this form then they can not take you off the driving or do anything to you. I f they do then acas will take the case up on your behalf.

This needs to be checked in your contract, and also each individual should contact acas as well.

I cannot see why RM must check our licence's with DVLA,Surely if I bring a valid driving Licence in to show the manager that should be enough,If I made a false declaration or showed a dodgy licence I would expect to face the penalties,if on one hand they are trusting us to handle mail but not trusting us to show our correct details,where has the trust gone,I will refuse to sign away my right's under the data protection act

I Know this post is going back to the beginning of last year but does anyone have an update on this. Is DRA and licence checks now agreed and if so, any LTBs relating to this would be useful.

Drivers Risk Assessment – Driving Licence Mandate



Further to LTB 154/08, the department has received a number of enquires concerning the requirement for drivers to sign a Driving Licence Mandate form as part of the Driver Risk Assessment procedure (DRA). The DRA is an agreed process and is supported by the CWU and is run on behalf of Royal Mail by Interactive Driving Systems (IDS), who own the software, carry out the analysis and administer the risk assessment system.



We are aware that DRA requires the signing of the Drivers Licence Mandate but we are satisfied that the information will be held securely and in-confidence. Importantly, all information provided is covered by the Data Protection Act 1998 (DPA) and as such there are legal restrictions placed on the use of all the personal data provided. In these circumstances we see no issues around signing the mandate. However, to provide further assurance please see below answers to specific points raised with the department.



Selling Data to a Third Party



It is illegal without the driver’s individual consent to sell personal date. This would contravene the DPA and in all probability lead to IDS having their licence withdrawn and open to litigation by drivers. Additionally, it would contravene the agreement IDS have with the DVLA and termination of that agreement.



Reference to Interactive Driving Systems and ‘their agents’



This refers to contractual arrangements that IDS may have with the DVLA and/or any sub contractors that act as ‘agents’ of IDS. Any unauthorised release of information would possibly result in termination of contracts and would contravene the DPA.



After signing the mandate are any driving offences automatically notified to Royal Mail via IDS?



This function is not available via DVLA. Once the mandate has been signed and the drivers' licence has been checked Royal Mail does not receive automatic updates.



Can a person withdraw from the mandate after signing up?



Only if the driver ceases to drive in Royal Mail; if that driver then resumes driving the DRA team will need to be notified in order that their status can be changed back to 'driver' status.



Is the mandate time-limited?



The mandate is valid for 3 years. Once this has expired, another mandate will be issued to the driver asking them for permission to make another check.



It should also be noted that, because of the very limited amount of information RM acquire (name & number) from the mandate, driving licences will still be subject to six monthly manual checks.

Telemetry/ RTA Procedure/Driver Interventions



Following the successful negotiation of agreements on Driver Risk Assessments and the initial introduction and piloting of Vehicle Telemetry, earlier this year the Union has been engaged in national discussions with Royal Mail on a further suite of agreements under the banner of Keeping our Drivers Driving which includes how information gained from telemetry will be used operationally and in individual cases.



Discussions have centred on establishing a joint Royal Mail/CWU approach to driver related issues based on a remedial rather than punitive objective and have encompassed talks on a revised Road Traffic Accident (RTA) Procedure, to be renamed the Driving Safely Procedure and counselling, support and training initiatives/interventions. While good progress has been made, Branches are advised that at this time no final agreement has been reached and as such the current RTA Procedure and associated processes remain in place.



Unfortunately, CWU HQ has been made aware that Royal Mail in some areas are attempting to unilaterally introduce amended Telemetry/ RTA processes which have never been agreed at the national discussions. In some cases managers have presented un-agreed telemetry processes as Health and Safety initiatives, an approach which will undoubtedly undermine national talks if allowed to continue.



Nationally we understand information emanating from telemetry is sensitive and for that reason alone it will take a nationally agreed process to ensure it is used in a fair and consistent way. Until such time as national negotiations are concluded and agreement reached, Branches are strongly advised not to enter into any local discussions or agree any amended RTA/Telemetry arrangements. Furthermore Branches are requested to bring any proposals received to the attention of CWU HQ as a matter of urgency.



Branches are asked to give the contents of this LTB the widest circulation and will of course be advised of developments in due course.
