Union haven't yet decided to take it on yet . Rm can't find two of my rtw what's vitally important for my case and there's , bloody typical of rm incompetence

Write to them asking for them.
Keep a copy of your letter for evidence.
Its not incompetence on their part....they will use any tactic to enhance their decision

You need to send an SAR request and pay the £10 it should take 40 days. Don't delay as you stage notes may well vanish in thin air.

Problem is they're saying they didn't do them , and I'm pretty certain they didn't , also on one rtw I've got there's a page missing which would connect two absences . This rtw was given to the appeal manager , but one page of my interview with my line manager stating the reasons I was off as disappeared . I've got three copies now of this rtw and its missing on all three .i don't know how the appeal manager can come to her conclusion tthat the absences are not connected when she's missing the documentation proving it is .

How can it be too late, you get the bundle two weeks before Tribunal and also if you include in your statement about the missing rtw RM will have to explain the missing documents to the Tribunal and then show their incompetence ?

You've taken the words right out of my mouth . If they haven't got all the documents , I feel appeal manager investigation is flawed and I can't c how she as come to that decision without all the evidence . I'm sure there lawyers will argue that's it not important . But if this was a criminal case it would be thrown out of court for lack of evidence . I suppose my solicitor could argue rm have deliberately lost them so I can't proof they were connected . Inteeresting?

the exchange of evidence is most important
even though it is a tribunal and not a court of law, CPR still exsists
thats civil procedure rules
you can claim substantive costs for their lack of compliance and then the circuit judge will prob issue directions to royal mail solicitors to comply or throw their defence out
but this is normally done through the mediation, and pre trial hearing stage

What documents would a RTW interview outside formal procedures without representation produce?
The form RM are using at RTW interviews is not agreed with the union and does not form any part of the Attendance Procedure.
How useful does that make it at an Employment Tribunal if it's not part of the agreed procedure?

The rtws would still be a part of following the procedures?????
If they don't put em in the bundle play that card to the Max
They missed out stuff from my bundle and it gave some vital pointers to me

Also remember if rm and the claimant are jointly at fault the award will be reduced by up to half before the loss factors come into force
