I don't know whether there's any recent ones. But I know of one case in the NW, where a few years ago, someone did (sacked for allegedly making a false claim of B&H against a Manager). I can't post any details about it now though, because I got into trouble last time I did. Some of the longer standing members of RMC may remember the case, as I had to remove the topic I started, asking for help and advice for him. Aparently the case was too well known, and therefore the Manager might be identified.

Any ideas on how I construct my witness report ,most of my witnesses are managers are they just going to stick together and come up with the same version if events to cover themselves , do I call the union repand area rep as witnesses nobody fom the union has advised me

In my experience yes.
It takes real integrity for a manager to speak out against another.
It also usually means the sideways shuffle into managerial obscurity.

You write YOUR witness statement and if any of your reps are involved and they are willing, then get a statement off them,you worry about what the managers write afterwards,as much of it will be scripted off Royal Fails lawyers anyway and yes they will all stick together or blame one another either way who cares,you can make them look stupid in tribunal. :dance

Anyway witness statements are usually done after disclosure of documents, plenty of time for you to not worry about them yet,you should be asking for the minutes to your appeal and dismissal and any other documents you might think will be helpful to your case, Atos Reports :hmmmm back to work bolloxs,if you want do a draft witness statement(s) and keep adding to it upto when the tribunal and not Royal Mail Lawyers decide to exchange witness statements.

Jayfin, when you have your CMD or Case Management Discussion with the judge that's where the number of witness's statements will be determined, my guess is that the statements will be from the appeals manager,dismissing manager, yours and any specialist reports on your condition. Tribunals these days will not tolerate too many witness's because its makes the hearing too lengthy and a huge cost to public funds.

they dont like too many but if you stress they are important they have to allow them i think.

If the Employment Tribunal upholds the dismissal by RM then you could appeal against their decision but it would have to be on a point of law, not allowing important witness evidence may be that point.

Went in to c my Dom to take my uniform back ( ha ) .to be fair only been there 2 months so wasn't fully in tune with my case . Anyway went through a few things with him about my case asked for all my return to work and low and behold . The one I need for my et they haven't got because they haven't done one which would connect two absences which triggered a stage 2 . Absolutely incompetence at it's best . Im happy ,without that rm haven't got a case against me but I'm fuming that I still can't do any thing about it until my et . Bloody processes and red tape where is there commonsense . They should be made at et to reinstate but I suppose they won't . We've cocked up , we've sacked you unfairly , we don't have to pay your for 15 years or pay into your pension . But go away with abit of compo if you win . It's totally corrupt . Time the big wig union bosses to stand up and protect there workers . My area rep is disillusion in the way the union going .io know there's brilliant reps and I've had great advice on here . I've said it before the higher up it goes in my opinion the more there out of touch they are . Until they want to use us as pawns in there game . Im cynical because of the savings are Dom was told to make . He increased 5 part timers hours up from 25 to 30! Total 25 hourss more a week this was agreed at the time of me being dismissed . He as still saved 15 hours by dismissing me and it appears he's givin the union what they want because they'd been arguing about increasing pt hours months before . People may say good management . I don't because if I'm right can't proof it . It would seem they had predetermined my outcome and they were just going through the process that's why appeals managers investigation wasn't thorough . Dom now ,line manager ,union rep , ex union rep , area rep . All have said I shouldn't have been dismissed and should be on stage 2 .which leads me to my conclusion that rm remit from above us get full timers out at all costs . Good luck to all fellow workers , watch your back . You never know when TNT take over I might be able to reapply lol

What do you know about my sick record militant , if rm wasnt so incompetent in not following there procedures I wouldn'tbe in the position I am . I think you need to read all the posts and u will clearly find the overall majority agree that I should be on a stage two , so yes if rm managers r not up to the
Job and it's not just me there dismissing unfairly . Then I do hope when the privatisation comes and it will this time . Than these so called rm managers feel the heat when TNT want to bring there own people in . , because like there workers Some of them should be sacked because they clearly can't manage people . Today in my depo they had 5 managers doing postal deliveries in my opinion that is wrong . We were short staffed before they dismissed me . If they were any good at man
Management they could have taken me to one side and basically gave me a kick up the backside and it would have worked and I dare say it would have worked for alot of other guys who's been dismissed . Two manages had to come in from outside are area to cover the duties it's crazy situation . My ex manager was one travelled 30 miles . What is bloody going on when there sacking workers and then managers taking out the dutie because they can't cover it . Some bloody service . So my friend if I sound bitter I am , I hope you never find yourself in
