well if you do win make sure you stress the point that wrongfully dismissing you was an action done to deprive you of IHR if you didnt get your job back if you won a tribunal.
I have stressed this point along with duty of care .
make sure the point is in your witness statement.....ive put mine at the end.

lets put it this way.
if i win my case and the judge takes on board the reasons why they have acted unfairly he could use it against them if they didnt give your job back....ie.compensationwise.
if my case gets to that point they will have to be very carefull in similar cases in future.

Hi Jayfin,
What exactly are you going to the ET for? Is it for unfair dismissal only or have you included any other protected characteristic such as disability discrimination or victimisation?
If you've claimed for any of the other things, you might get a Vento award for injury to feelings. If not, in your schedule of loss you could claim for loss of earnings for the period of time since your dismissal to the date of your ET.
You could also claim for loss of future earnings while you're still job-hunting, you will also have to show that you've actively been looking for employment but, in this current economic climate - 12-24 months or so?
Likely to be put onto minimum wage in any new job so the difference between your current hourly rate and minimum wage = £3.50 x 39 hours x 52 weeks (or 104 in current climate)
Loss of Royal Mail contribution into your pension which I believe is 20% of net?? earnings for the 12 months you're like;ly to be out of work.
Possible loss of holiday entitlement, we get 5 weeks, statutory minimum which new employees would be likely to get is 4 weeks, I think.
Add all this up, divide by 4, multiply by 5, that will give you the net figure after the taxman has taken his 20% of your award so add this figure to your schedule of loss.
If this is wrong, I stand to be corrected, sorry, but it's some of what I put on my schedule of loss. You can argue the toss with Weightmans at your CMD.

Right even more confused about time limits on when return to work interviews should be done . Some of mine have taken up to 20 days to be done after I've returned .one of my fellow workers went in for a stage two today and it didn't get issued because our acting Dom said he couldn't issue it because his rtw interviews were done to late 7 days and 5days after he returned . Dom told him his absences are obsolete through rm not doing there rtw interviews within the timeframe agreed .my colleagues absences were flu and chest infection so no mitigating circumstances . I've tried before to get a clear answer to this question before but it seems to b a grey area depending on the Dom , si when my colleague told me , I stupidly asked the Dom wether I could have it in writing which u can guess I got a no .

Finally my last day of my notice period as arrived tomorrow . In hindsight I should have left once I knew I lost my appeal . I didntthink it would be this bloody hard to leave a company who doesn't want me anymore and in my notice period still give them100% . I'm dreading tomorrow because I'm emotional wreck at the moment , I'm angry , confused , bitter I've tried not to let them grind me down so I'd like to thank everyoneon here who's supported me and gave me advice . In my dark moments it's kept me positive . Cheers everyone and good luck with your own battles with the evil bstards
