So not being a full time official anymore the company expect him to go back to operations. Is that not the norm? What exactly is the case about?
It was agreed as Chair He would have full time release in 2003. He took over as the Area rep's position that did not attract full time release in 2009. The agreement in 2003 was never terminated or reviewed by the Employer.

You don't have to be either as long as the business recognise you as a union rep.

He has also applied to the Employment Tribunal for a National Officer to attend to give evidence. Check out his Facebook page for the latest news.

Royal Mail have accepted the Agreement will have to got through the Framework, ten months on since stating it was 'not proper' to the IR Framework.

Meanwhile, Jim is still of sick. On half pay and Jim did not receive his SSP1 certificate from Royal MAil. Royal MAil have failed to pay him for taking annual leave as per the policy. Despite the annual leave being pre-booked by at least 6 months with reminders and a pathetic excuse of 'We did not know.'

Jim is now calling on all the Managers to be disciplined who are involved in the case and there ares some big names involved too.

So, If he's not a area rep or a unit rep why would the business recognise him as a union rep? Still not sure what he wants out of this. Will a successful outcome mean he goes back to fully paid employment but won't be on operations? What will he do then given that he holds no Union post? Not trying to be obstructive but it's still confusing.

From my reading of the case its not just his recognition, but how he was treated on his return to the workforce, and how H&S violations/concerns that he reported were treated by managers, and Royal Mails refusal to recognise that he has an Industrial Injury.

Union rep hearing for detriment and discrimination 3 weeks away.

Post by TheBushBaby »

That's right folks its been two years and the full hearing is now only 3.5 weeks away. I have learned today statements and a bundle has been exchanged. The hearing starts on the 16th of March 2020 at Watford Employment Tribunal. Prominent members of Royal Mail Management are giving evidence and two employees of the CWU have been ordered by the court to attend to give evidence as they would not submit a statement in support of the Claimant Jim Murphy, CWU Chair.

The Hearing is listed for one week, with the bundle containing 600 pages of evidence. There is of course time for a out of court settlement, however that time is waiting for no one as both sides will be scrutinising in public our National Agreements.

Watch this Space.

Jim tells me there is of course still time for a out of court settlement. Even at the steps of the court house.

From what I am reading and hearing, the Judge is going to give them the reading day on Monday to work out an agreement, failing that the hearing will go ahead.
