My argument still stands. All they have is a recommendation not an agreement, going along with the recommendation should be voluntary, unless a vote has been taken by the membership (even then there are qualifications).

Its not an agreement if only Managers and Reps discussed it.

Its an agreement when
WE the membership endorse it.
It is a lovely theory but impractical.
The (area) manager says to the (area) rep:
We expect day Y to be very light and your members will be finishing early but rather than hold them to their time as we are entitled to do, we want 40 minutes extra on day X to compensate.
Now it would be lovely for the area rep to visit every office and hold a vote with every union member in attendance but that isn't going to happen. Space time and distance and all that.
So he has to make a judgement call and like you said earlier in the thread - most would take an early finish on day Y.
But can they finish early on the 24th or will they evoke another clause these agreements have more holes than a sieve I prefer the way I have always worked to my conditioned hours no more no less.

If it was me, I would still report for work at my normal Tuesday time and work my normal Tuesday hours.

If I finished my duty early, I would ask managers if there is anything specific they want me to do until my normal contracted Tuesday finish time, or are they happy for me to do some D2D prep for frames in my section.

In the case of our office I would expect most members would be happy if that was how it went. The only problem is we have been TOLD to come in early without getting anything given back, and, to make it even more uneven, only affects full-time delivery staff.

Happy days if you're P/T or in the callers office or a late driver.

Isn't this classed as a "claw back" of hours?

That would only apply if the judgement call was in line with the relevant national agreement, area reps don't have the authority to work outside of those, this case clearly isn't in line with anything, individual circumstances must be taken into account with flexing up or down and they haven't been.

exactly, the area rep does not have the authority they feel she/he has. It might be an idea to do this and some may like it but working outside of the time you have signed for is voluntary for a start. The area rep could reach agreement without consulting local reps and any good rep would insist on the words voluntary.

So, today, the DOM showed the staff a copy of the agreement made with the area rep which stipulated (with "no exceptions") that we would be working an extra 40 minutes this morning. For free.

No consultation and 24hrs notice.

What a wonderful employer we all have.

Sounds like the AR fancies stepping down soon. Get an explanation as to their reasons and authority for doing this or get shot of them.

you need to get hold of the area rep as soon as. Ignore the manager. Dont do it, this is an issue for your local reps to deal with.

But he hasn't agreed to flexing he has agreed to a variance in start times.
I have seen posts on here before where, after a Bank Holiday Monday and Tuesday's hours have been swapped in some units where the shorter Tuesday doesn't have sufficient hours for the expected traffic.
It isn't anything to get overexcited about.
As long as people are getting paid for the hours they work and they are working the hours they are getting paid for it is all good.

As for individual circumstances - then those people need to voice their concerns.
If for example you get to work by public transport and you catch the first available bus/train/helicopter then just go and tell them that you can't start earlier and explain why. It isn't difficult.

If we worked in a normal place then a manger would simply talk to the staff, explain the issue and how they wanted to solve it and the staff would probably agree with the proviso that anyone with a genuine problem could approach the manager to try and find an alternative solution.
But this is RM so we have to have a signed agreement with an Area Rep for no good reason except RM is staffed in some instances by bellends.
