ATOS Origin are merely RM's Agents / Contractors and the golden rule is the contactor never upsets the cilent RM , they are under strict orders from RM Senior Management , and everything is to a foregone conclusion.
Sorry but where this is a will there's a way with RM . If anything underhand does happen a BS /Area Rep will quickly find the contradictions/ suspicious issues / "strange " "coincidences - that whether RM like it, or not is the Union's job - DO NOT take anything @ face value and always question /contradict / play devil's advocate . There is a arrogant take us on then, mentality stemming from on high .T ypical RM one idea .
Look at the postie from Macclesfield who was on light duties doing his round in a van as he'd been in Hospital and was on a dyalsis machine -on PAPER it complies with the DDA Act but one day he cut off only to come back to a trumped up Wilful Delay Charge -all those managers swearing blind he hadn't informed in any way. RM wanted him through the door to be replaced by a part-timer .
Fortunately the lads backed him up by going on unofficial strike and by "coincidence " the wilful delay charge was dropped . One of RM's "cunning plans ">

legally they should take you off attendance procedure if covered by DDA but you are warned to take care ( draw your own conclusions from that it's based on the RM statement we must make lifestyle choices to avoid unecessary absence and if RM think you don't, RM will try it on ),Edward Hunter wrote:I know someone who has survived 5 RTUs! RM will SOMETIMES superficially comply with DDA if the magic words IT ,are mentioned but RM plan to force a new attendance through withdrawing DDA protection .
Watch the ATOS Origin Doctor doesn't shaft you/stitch you up and if he does you can bet your bottom dollar a RM manager will be behind it .
ATOS Origin are the extended arm of RM , RM use them to cover their sorry arses against litigation, and don't fall for all this is all your own fault nonsense as RM will try that .I agree over reps going in,
EVERYTHING is purely to impress Senior/Area Mgt and those local managers want Senior/Area off their backs .

I suffer from asthma and i am off at the moment with a chest infection which is also inhibiting my breathing. I'm a H&S rep and looked into DDA, if you have been on medication for over a year and that medication is helping you lead as normal life as possible then you should be covered by the DDA. Some EHS doctors will need to have this pointed out when you are attending an interview i usually try to attend with a member in case the member is not sure of the ruling and may have the wool pulled over their eyes.

An update to this thread.
3 Weeks ago I was admitted to hospital as I had a chest infection and had an asthma attack in the evening. I ended up being kept in hospital for 5 days. On my return to work my manager had arranged a meeting with EHS which I attended.
The EHS Dr was very good. As my back problems tend to affect my upper back rather than lower, he said that there wasn't anything he could do except recommend physio and painkillers. He also suggested that I carry on as usual and hope that my back behaves. He did note that if my back continues to play up ( unfortunately - it seems that standing sorting acts as the trigger) the manager should maybe look to change my role within RM possibly on the counter?
With regards to the asthma - he said that under DDA, RM cannot use this against me and will have to re-evaluate my position with regards to the stages that I have acrrued and dismiss all those related to the asthma.
My stage 3 meeting is scheduled for Tuesday 4th December.
We'll see what happens.....

I have helped deal with two cases similar to yours. One guy also suffered back problems and was an asthmatic, he only came to me when he was on a stage 3, but I managed to get it rolled back to a stage 2 and allowances made for the Asthma. He is now allowed 3 absences or 14 days before a stage 3 can be triggered. If he had come to me earlier, he could of got the same deal I managed to get for another member that is also classed as DDA. 5 absences or 21 days before a stage 1 is triggered.
RM managers don't really give a fecking toss about people, but they are frightened to death of adverse publicity when it comes to DDA. Crozier supposedly champions the cause, and its always nice to remind managers of this.

I don t know if this will help, but I believe that management should have offered you fast track pysiotherapy for your back injury. If they did not then you could ask your union rep to bring this up at the stage 3 meeting. Believe me, there will be one.
If they did not offer you this pysio, that they have access to, I would suggest that an error on managements part contributed to your backs condition worsening.
I find it amazing that when you attend the Royal Mail induction course before you start work, you are offered and prompted to join a private medical scheme. But when you need to use it you can be disciplined.

On the morning of the scheduled meeting, I asked our office union rep if the area rep was aware of my hearing. The office rep said " yeah....erm, no - erm...I'll give him a ring" and rang him. Several times. Eventually he got an answer and the area rep was on annual leave and had no knowledge of my hearing.
So, the office rep rang the stand in area rep. Again - no knowledge and he was out on delivery. The office rep told me to refuse to attend as I had no representation.
I went into my office managers office and told him that as I had no representation I would not be attending. He then informed me that it was MY job to inform the area union rep so either myself or the office rep had ufcked up and I should go. Being my 1st stage 3 - I had no idea of the way things "work" and the office rep has know since the beginning of my upcoming stage meeting - I even gave him a copy of the paperwork with the dates on and he told me the area rep was on to it.
Obviously not.
So, the office manager rings the area manager and tells him that I was not attending and why. The area manager gave HIM such a bollocking for not sorting it out and wasting time and money. I am currently awaiting a rescheduled date.
* As a sidenote - the area manager came to the office on Friday and spent much of it eyeballing me - to which I just smiled sweetly at him.
To top it off, while he was there, one of our female workers got caught up in one of the uncut plastic hoops that sit around magazines and went flying, cracking a knee a wrist and her face. He got involved and started shouting that these hoops are all supposed to be cut, to which he got abuse back as our OM locks the office at night so the early workers have no scissors to cut them.
So he then started on the fact that there were walksort trays and packet bags filling the aisles to which he received many "ufck off you fat b*stard - there's nowhere else to put them" shouts . After a quick word with the OM, he took off sharpish.
