Can i get sacked for being off sick

Hopefully my union rep has sorted things now, it also helped that my doctor wrote also stress on my sicknote so this is the first day my boss has left me alone, i hope to go back to work on my rehab plan next monday but i am still worried because i will get a stage 1 warning and because my foot still is'nt better im worried i will have to go off again with it, then get a stage 2 and so on. Not sure what the retail plan entails but it was mentioned about doing the callers office

If you're not up to it don't go in,you will get a stage 1 for 2 weeks sick,you will get a stage 1 for 4 weeks sick,if they run concurrently that is and so on.

If you have breached the standards under the attendance procedure i.e 4 absences or 14 days in a 12 month period. You will probably be notified that you have to attend a stage 1 meeting with the manager. You have a right to union representation at this meeting and they must give you 48hrs notice. From the impression you have given me of your manager it is important that you protect yourself. Your rep will probably already know but it is important that you request copies of the atos and physio reports. Within the atos report they should have considered and advised the manager on your particular health problem in relation to the disability and discrimination act which now comes under the equality act 2010. From what you have said you seem to meet the criteria to be classified under the act and it will afford you some protection against further discrimination. Your union rep will have access to this information and should cross check it with the related documents which are RM Attendance procedure and managing absence in service delivery (management guide).

any idea how i can get my atos reports, i feel my manager is saying he has'nt recieved certain ones he doesnt want me to see. I have phoned atos and they said all i can do is write to them requesting this, but its been nearly 2 weeks and i havnt heard from them

You will need to put your request in writing, by letter or email, and send it to the person or organisation you believe holds this information. Make sure to put your name and address and keep a copy.
